Amending O. Reg. 310/13
(ASSET TRANSFERS UNDER SECTIONS 80 AND 81 OF THE ACT)
1. (1) Section 5 of Ontario Regulation 310/13 is amended by adding the following subsection:
(3.1) If, under subsection (3), the last day on which an application must be filed is a day that falls on or after June 18, 2020, and before November 1, 2020, the reference in subsection (3) to “nine months” shall be read instead as “12 months”.
(2) Subsection 5 (3.1) of the Regulation, as made by subsection (1), is revoked.
2. (1) Section 6 of the Regulation is amended by adding the following subsection:
(2) If, under subsection (1), the last day on which the documents described in that subsection must be filed is a day that falls on or after June 18, 2020 and before November 1, 2020, the reference in subsection (1) to “60 days” shall be read instead as “120 days”.
(2) Subsection 6 (2) the Regulation, as made by subsection (1), is revoked.
3. (1) Section 15 of the Regulation is amended by adding the following subsection:
(2) If, under subsection (1), the last day on which the transfer of assets must be completed is a day that falls on or after June 18, 2020 and before November 1, 2020, the reference in subsection (1) to “120 days” shall be read instead as “180 days”.
(2) Subsection 15 (2) of the Regulation, as made by subsection (1), is revoked.
4. (1) Section 16 of the Regulation is amended by adding the following subsection:
(2.1) If, under subsection (2), the last day on which the notices required by this section must be given is a day that falls on or after June 18, 2020, and before November 1, 2020, the reference in subsection (2) to “six months” shall be read instead as “nine months”.
(2) Subsection 16 (2.1) of the Regulation, as made by subsection (1), is revoked.
5. (1) Section 21 of the Regulation is amended by adding the following subsection:
(2.1) If, under subsection (2), the last day on which the notices required by this section must be given is a day that falls on or after June 18, 2020 and before November 1, 2020, the reference in subsection (2) to “six months” shall be read instead as “nine months”.
(2) Subsection 21 (2.1) of the Regulation, as made by subsection (1), is revoked.
Commencement
6. (1) Subject to subsection (2), this Regulation comes into force on the day it is filed.
(2) Subsections 1 (2), 2 (2), 3 (2), 4 (2) and 5 (2) come into force on July 1, 2021.
