(MUNICIPAL RESIDENTIAL DRINKING WATER SYSTEMS IN SOURCE PROTECTION AREAS)
1. (1) Subsection 3 (1) of Ontario Regulation 205/18 is amended by striking out the portion before paragraph 1 and substituting the following:
(1) An owner of a municipal residential drinking water system that is located in a source protection area who applies for an amendment to the drinking water works permit or the municipal drinking water licence for the system in order to carry out one of the following activities shall ensure that the application complies with subsection (2):

(2) Subsection 3 (1) of the Regulation is amended by adding the following paragraph:
3. An increase in the rated capacity of the system, if the increased rated capacity would require changes to be made to the mapping of the related wellhead protection area or surface water intake protection zone identified in the assessment report portion of the source protection plan.
(3) Subsection 3 (2) of the Regulation is amended by striking out “to a drinking water works permit” and substituting “to a drinking water works permit or a municipal drinking water licence”.
2. Section 4 of the Regulation is revoked and the following substituted:
Conditions
4. (1) If a drinking water works permit or municipal drinking water licence referred to in subsection 2 (1) is issued for a new municipal residential drinking water system, the permit or licence must include a condition that prohibits the supply of drinking water to users of the system until any amendments to any applicable source protection plan included in the notice referred to in subsection 2 (2) have been,
(a) proposed and approved pursuant to section 34 of the Clean Water Act, 2006; or
(b) implemented as an update under section 36 of that Act.
(2) If a drinking water works permit or a municipal drinking water licence referred to in subsection 3 (1) is issued for a municipal residential drinking water system, the permit or licence must include a condition that prohibits the supply of drinking water from a new or altered well or intake to users of the system or, in the case of an activity described in paragraph 3 of subsection 3 (1), a condition that prohibits the use of the increased capacity of the system, until any amendments to any applicable source protection plan included in the notice referred to in subsection 3 (2) have been,
(a) proposed and approved pursuant to section 34 of the Clean Water Act, 2006; or
(b) implemented as an update under section 36 of that Act.
(3) Subsection (2) does not apply if the notice referred to in subsection 3 (2) includes,
(a) an indication that the source protection authority for the area in which the system is located is of the opinion described in sub-subclause 48 (1.1) (b) (vi) (A) of Ontario Regulation 287/07 (General) made under the Clean Water Act, 2006 and the explanation required under that sub-subclause; or
(b) the indication described in sub-subclause 48 (1.1) (b) (vi) (B) of Ontario Regulation 287/07.
Commencement
3. This Regulation comes into force on the later of the day subsection 11 (1) of Schedule 1 to the Building a More Competitive Economy Act, 2025 comes into force and the day this Regulation is filed.
