Order in Council 1111/2026

On the recommendation of the undersigned, the Lieutenant Governor of Ontario, by and with the advice and concurrence of the Executive Council of Ontario, orders that:

WHEREAS the Ontario Provincial Conservation Agency is an agent of the Crown established pursuant to the Conservation Authorities Act, R.S.O. 1990, c. C.27 as a corporation without share capital;

AND WHEREAS the Ontario Provincial Conservation Agency will be seeking approval from OMERS to be designated an employer participating in the OMERS Pension Plan for employees hired by the Ontario Provincial Conservation Agency on or before September 7, 2026;

AND WHEREAS the Ontario Provincial Conservation Agency has requested to be designated as a participating employer in the Public Service Pension Plan set out in Schedule 1 to the Public Service Pension Act, 1989, as amended (PSPP) and the Public Service Pension Plan Retirement Compensation Arrangement (PSPP RCA) as set out in Schedule 1, as amended, under Order in Council 1484/2025;

AND WHEREAS the Lieutenant Governor in Council considers it reasonable and appropriate for the Ontario Provincial Conservation Agency to join as a participating employer in the PSPP and in the PSPP RCA, and for eligible employees of the Ontario Provincial Conservation Agency to join the PSPP and the PSPP RCA (if applicable);

AND WHEREAS members of the PSPP whose pension benefits under the PSPP exceed the maximum pension benefits permitted under the Income Tax Act (Canada) in respect of registered pension plans also participate in the PSPP RCA;

AND WHEREAS the Crown is requesting that the Ontario Provincial Conservation Agency indemnify the Crown against any and all liabilities incurred in connection with the Ontario Provincial Conservation Agency’s participation as an employer under the PSPP and the PSPP RCA;

AND WHEREAS the Ontario Provincial Conservation Agency has committed to indemnifying the Crown against liabilities incurred in connection with its participation as an employer under the PSPP and the PSPP RCA by executing an indemnification agreement by no later than September 8, 2026;

NOW THEREFORE PURSUANT TO:

1. paragraph 2 of subsection 2(1) of the PSPP, all permanent full-time and permanent part-time employees of the Ontario Provincial Conservation Agency are designated as a class of employees who are required to become members of the PSPP, in respect of service with the Ontario Provincial Conservation Agency, on and after September 8, 2026; and
2. subparagraph 1(b) of subsection 2(2) of the PSPP, all fixed-term full-time and fixed-term part-time employees of the Ontario Provincial Conservation Agency are designated as a class of employees who are entitled but not required to become members of the PSPP, in respect of service with the Ontario Provincial Conservation Agency on and after September 8, 2026, and shall, upon filing a written election with the Ontario Pension Board, become members of the PSPP;

AND FURTHER THAT the Ontario Provincial Conservation Agency shall be an employer under the PSPP and the PSPP RCA for the purposes of the employees designated in this Order.
