On the recommendation of the undersigned, the Lieutenant Governor of Ontario, by and with the advice and concurrence of the Executive Council of Ontario, orders that:

Whereas the City of Niagara Falls owns an unopened road allowance adjacent to 12051 Niagara River Parkway, in the City of Niagara Falls (the “Bossert Road Allowance”);

And whereas The Niagara Parks Commission wishes to acquire a portion of the Bossert Road Allowance having the description set out in Schedule “A”, attached hereto, (the “Subject Lands”), for a future service road;

And whereas subsection 7(1) of the Niagara Parks Act authorizes The Niagara Parks Commission, subject to the approval of the Lieutenant Governor in Council, to acquire by purchase, lease or otherwise any land or any interest in land and to sell or otherwise dispose of any land or any interest in land;

Now therefore, pursuant to subsection 7(1) of the Niagara Parks Act, approval is hereby given to The Niagara Parks Commission to:

  1. purchase the Subject Lands from the City of Niagara Falls; and
  2. execute such documents as may be necessary for that purpose.
