Order in Council 1313/2026
On the recommendation of the undersigned, the Lieutenant Governor of Ontario, by and with the advice and concurrence of the Executive Council of Ontario, orders that:
Whereas subsection 159(6) of the Workplace Safety and Insurance Act, 1997 provides that with the approval of the Lieutenant Governor in Council, the Workplace Safety and Insurance Board ("Board") may acquire real property that the Board considers necessary for its purposes and may dispose of it;
And whereas the Board through its subsidiary 799549 Ontario Inc. has a co-ownership interest in the premises known municipally as 200 Front Street West in the City of Toronto, commonly known as Simcoe Place (hereinafter referred to as the "Front Street Tower").
Further, the Front Street Tower is situated on land leased pursuant to the "Front Street Tower Parcel Lease" dated June 19, 1992, as amended, between the Canadian Broadcasting Corporation, Simcoe Front Developments Ltd. (Cadillac Fairview Corporation Ltd.) and the Board (the "Amended Land Lease Agreement");
And whereas the Board, in 2006, obtained an Order in Council (OIC 1536/2006) approving the Board’s participation in a revised land lease arrangement as set out in the Amended Land Lease Agreement, through which the Board acquired the option to participate in the purchase of the land upon which the Front Street Tower is situated when the Amended Land Lease Agreement expires in 2027;
And whereas the Board of Directors of the Board on April 23, 2026 authorized the President and Chief Executive Officer of the Board to seek an Order from the Lieutenant Governor in Council approving the exercise of the option to purchase the land upon which the Front Steet Tower is situated, as set out in the Amended Land Lease Agreement, at a cost of $1,500,000 payable on the closing date, May 30, 2027.
And whereas the Board considers it necessary for its purposes to acquire in fee simple certain real property located in Toronto, Ontario;
Therefore pursuant to subsection 159(6) of the Workplace Safety and Insurance Act, 1997, the Board, through its subsidiary 799549 Ontario Inc., is approved to exercise the option to participate in the purchase in fee simple from the Canadian Broadcasting Corporation the real property legally described in Appendix “A” that is located at the municipal address 200 Front Street West, Toronto, ON, M5V 3L1 for a purchase price of one million and five-hundred thousand dollars ($1,500,000).
