On the recommendation of the undersigned, the Lieutenant Governor of Ontario, by and with the advice and concurrence of the Executive Council of Ontario, orders that:

Whereas subsection 159(6) of the Workplace Safety and Insurance Act, 1997 provides that with the approval of the Lieutenant Governor in Council, the Workplace Safety and Insurance Board ("Board") may acquire real property that the Board considers necessary for its purposes and may dispose of it;

And whereas the Board considers it necessary to acquire certain lands in Sudbury, for the purpose of establishing an Ontario Mine Rescue Training Institute, to be operated by Ontario Mine Rescue, a division of Workplace Safety North;

And whereas pursuant to subsection 172(1) of the Workplace Safety and Insurance Act, 1997 the Board is required to pay for the reasonable expenses of establishing, maintaining and operating mine rescue stations under the Occupational Health and Safety Act;

Therefore, pursuant to subsection 159(6) of the Workplace Safety and Insurance Act, 1997, the Board is approved to purchase, via a subsidiary, in fee simple from the City of Greater Sudbury the real property legally described in Appendix “A” that is located North of LaSalle Boulevard, Sudbury, to which no municipal address is assigned, in the Township of McKim and the City of Greater Sudbury for a purchase price of two dollars ($2) subject to the following conditions:

  1. The Board shall comply with the applicable requirements of the Government Property Class Environmental Assessment made under the authority of the Environmental Assessment Act prior to the development of the lands and the construction of the facility; and
  2. The Crown, as represented by the Minister of Labour, Immigration, Training and Skills Development, shall fulfill its duty to consult affected Indigenous communities prior to the commencement of the development of the lands and the construction of the facility.
