Order in Council 858/2026
On the recommendation of the undersigned, the Lieutenant Governor of Ontario, by and with the advice and concurrence of the Executive Council of Ontario, orders that:
Whereas His Majesty the King in Right of Canada as represented by the Minister of the Environment for the purposes of the Parks Canada Agency (the “Federal Government”), and His Majesty the King in Right of Ontario as represented by the Minister of Infrastructure and the Minister of Transportation (together “Ontario”) entered into a Memorandum of Agreement Respecting the Establishment of the Proposed Rouge National Urban Park (the “Park”) dated January 26, 2013 (the “Agreement”);
WHEREAS the Lieutenant Governor in Council provided approval on August 30, 2017, through Order in Council 1715/2017 (the “Order”) for the administration and control of the lands described in the Order (the “Lands”) to be transferred from the Minister of Infrastructure to the Federal Government;
Whereas the federal Minister of Environment and Climate Change, pursuant to subsection 5(2) of the Federal Real Properly Regulations accepted on October 21, 2017, on behalf of His Majesty the King in Right of Canada, the transfer of administration and control of the Lands from His Majesty the King in Right of Ontario;
Whereas under the Agreement, the Lands were required to be designated as part of the Park pursuant to the Rouge National Urban Park Act, 2015 by October 21, 2022;
Whereas the Federal Government and Ontario agreed to extend the period set out in the Agreement to designate the Lands from five years of the date of any transfer of administration and control to ten years through an Amending Agreement dated February 1, 2026;
Whereas it is considered desirable to amend the Order to reflect the extension of time provided for in the Amending Agreement as agreed to by the Federal Government and Ontario;
Now therefore, pursuant to the inherent jurisdiction of the Lieutenant Governor in Council, Order in Council 1715/2017 dated August 30, 2017, is hereby amended by:
1. Striking out the words “five years” and substituting them with “ten years”.
And that this Order in Council is effective on the date it is made.
