Notice of approval

Take notice that the period for requesting a hearing, provided for in the Notice of Completion of the Review for the above noted undertaking, expired on July 21, 2000. received one submission before the expiration date. No submissions requested a hearing by the Environmental Assessment Board.

I do not consider it advisable or necessary to hold a hearing. Having considered the purpose of the Environmental Assessment Act (EAA), the Environmental Assessment and its approved Terms of Reference, the Review and submissions received, I hereby give approval to proceed with the undertaking, subject to conditions set out below.

  1. The proponent, KMS Peel, Incorporated, shall comply with the provisions ofthe Environmental Assessment (EA), all of which are incorporated herein by reference, except as provided in these conditions and as provided in any Part V and Section 9 Environmental Protection Act (EPA) approvals and any other approvals or permits that may be issued for the undertaking.
  2. These conditions do not prevent more restrictive conditions being imposed by other statutes.
  3. The prooonent shall continue to facilitate the operation of the Peel Liaison Committee so that it may continue to provide a forum for interaction between the proponent and the public for the life of the undertaking.
  4. Copies of all submissions by the proponent to the Ministry of the Environment, Environmental Assessment and Approvals Branch for approvals under the EPA shall be provided by KMS Peel, Incorporated to the Commissioner of Public Works of the Regional Municipality of Peel.
  5. This approval does not prevent the proponent from installing additional air pollution control equipment or waste treatment or management systems in the future, to deal with ash or air emissions from the existing incinerator or the additional incinerator approval by this approval, subject to the approval process under the EPA.

Reasons

My reasons for giving approval are:

  1. On the basis of the proponent’s Environmental Assessment and the Review, and the proponent’s conclusion that, on balance, the advantages of this undertaking outweigh its disadvantages appears to be valid.
  2. No other beneficial alternative method of implementing the undertaking was identified.
  3. On the basis of the proponent’s Environmental Assessment and its approved Terms of Reference, the Review, the submissions, and the conditions of approval, the construction, operation and maintenance of the undertaking will be consistent with the purpose of the Act (section 2).
  4. The Government Review Team has indicated no outstanding concerns that can not be addressed through conditions of approval under the EPA. The public review of the Environmental Assessment did not identify any outstanding concerns which can not be addressed through these conditions of approval or conditions of approval under the EPA.
  5. The submission received after the Notice of Completion of the Review was published can be dealt with through conditions of approval under the EPA, where appropriate.
  6. I am not aware of any outstanding issues with respect to this undertaking which suggest that a hearing should be required.
