Notice of approval – terms of reference

As provided for by subsection 6.(4) of the Environmental Assessment Act (EAA), Terms of Reference (ToR), as submitted for approval to the Ministry of the Environment on February 13, 2002, to govern the preparation of an environmental assessment for the above-noted undertaking, are hereby approved with the following amendments:

  • The full text of section 7.9 Waste Diversion shall be changed to read:

    The EA shall describe the remaining capacity under the current Provisional Certificate of Approval for a Waste Disposal Site issued for the site and a summary of the status of implementing the components of the waste management system required under Green Lane’s approved November 1996 EA.

    The EA will examine on-site opportunities to further increase the diversion of waste from the landfill and develop an on-site waste diversion strategy regarding their implementation.

Pursuant to subsection 6.1(1) of the EAA, any environmental assessment for the above-noted undertaking, submitted to the Ministry of the Environment pursuant to subsection 6.2(1) of the EAA, must be prepared in accordance with the ToR, dated June 22, 2001, and revised through the submission of ToR dated February 2002, as hereby amended and approved.

Reasons

I am satisfied that an environmental assessment carried out in accordance with the ToR received on February 13, 2002, as amended by this approval, will be consistent with the purpose of the EAA and the public interest for the following reasons:

  1. The ToR identify issues and concerns, and the preferred means of addressing them with due regard to adoption of environmental management, protection and mitigation measures, and requires the proponent to prepare an environmental assessment that will address these issues appropriately.
  2. The government review team has indicated that they have no outstanding concerns with the ToR once it is amended by the Minister.
  3. As the ToR have been prepared pursuant to clause 6(2)(c) and pursuant to subsection 6.1(3) of the EAA, the resulting environmental assessment will consist of the information outlined in the ToR.
  4. The ToR require the proponent to implement a comprehensive consultation plan outlining the timing and types of consultation that will occur during the preparation of the environmental assessment. In addition, there will be additional opportunities for public and agency consultation when the environmental assessment is submitted to the ministry.
  5. Amendment 1 addresses agency concerns that were raised during the review of the ToR.
