These particulars are posted following the issuance of Notice of Contravention with Administrative Monetary Penalty against a business by the Superintendent of Private Career Colleges pursuant to s. 39 (1) of the Act.

On April 30, 2021, it was determined that the Caribbean Flying Club Inc. contravened the following section(s) of the Private Career Colleges Act, 2005 (“PCCA” or the “Act”) and an Administrative Monetary Penalty was Issued pursuant to O. Reg. 415/06 s. 51.

Subsection 39 (6) of the Act provides that a person who received a notice of contravention may require the Minister to review the notice of contravention by applying for a review in a form approved by the Superintendent within 15 days after receipt of the Notice of Contravention or if the Minister considers it appropriate in the circumstances to extend the time for applying, within the period specified by the Minister.

Caribbean Flying Club Inc. submitted an application for review of the notice of contravention on or about July 8, 2021, which was 69 days after its issuance. On December 19, 2022, having reviewed the application and related materials in the submission, the Office of the Minister did not find it appropriate in the circumstances to extend the time for submitting the application and declined the request to extend the timeline provided by Subsection 39 (6) (a) of the Act.
