Particulars of a Compliance Order 

s.49 (2) Ontario Career Colleges Act, 2005 (“Act”)

These particulars are posted following the issuance of a Compliance Order against a registered career college by the Superintendent of Career Colleges pursuant to s. 46 (2) of the Ontario Career Colleges Act, 2005 (the “Act”).

Contraventions

The Superintendent ordered 1604240 Ontario Inc. o/a Moga Truck Driving School to:

  • Stop contravening subsection 23 (4)  (Conditions) of the Act while delivering the Tractor-Trailer (AZ) program by failing to teach the alley-dock backing manoeuvre in accordance with the requirements of performance element 5.1.3 of the Ministry of Transportation’s Mandatory Entry-Level Training Standard (the MELT Standard).
  • Stop contravening subsection 23 (4) (Conditions) of the Act while delivering the Tractor-Trailer (AZ) program by failing to use daily lesson plans that meet the requirements of the MELT Standard.
  • Stop contravening subsection 23 (4) (Conditions) of the Act by hiring and using instructors to teach the Tractor-Trailer (AZ) program that do not meet the instructor qualification requirements of the MELT Standard.
  • Stop contravening subsection 12. (1) (Condition of approval and duration) of Ontario Regulation 415/06 (the “Regulation”) made under the Act by completing pre-midpoint evaluations for students in the Tractor-Trailer (AZ) program after students have already finished the first half of the program.
  • Stop contravening subsection 20. (1) (Enrolment contracts) of the Regulation by failing to include all of the required terms provided in subsection 20. (1) of the Regulation in your vocational program enrolment contracts.

Required actions

By May 16, 2024, 1604240 Ontario Inc. o/a Moga Truck Driving School was required by the Superintendent to provide written confirmation signed by a person with authority to bind the corporation, together with all available supporting evidence, confirming that they would:

  1. Teach the alley-dock backing manoeuvre in accordance with the requirements of performance element 5.1.3 of the MELT Standard, pursuant to subsection 23 (4) (Conditions) of the Act.
  2. Use daily lesson plans that meet the requirements of the MELT Standard to deliver the Tractor-Trailer (AZ) program, pursuant to subsection 23 (4) (Conditions) of the Act.
  3. Employ instructors that meet the instructor qualification requirements of the MELT Standard to deliver the Tractor-Trailer (AZ) program, pursuant to subsection 23  (4) (Conditions) of the Act.
  4. Complete pre-midpoint evaluations for all Tractor-Trailer (AZ) program students before they complete the first half of the program, pursuant to subsection 12. (1) (Condition of approval and duration) of the Regulation.
  5. Use student enrolment contracts that include all of the required terms provided in subsection 20. (1) (Enrolment contracts) of the Regulation.
