These particulars are posted following the issuance of a Restraining Order against an unregistered institution by the Superintendent of Private Career Colleges (the “Superintendent”) pursuant to s. 49 (2) of the Act.

Contraventions

The Superintendent ordered 6468144 Canada Inc. o/a New Baba Driving School to stop contravening:

  • Subsection 7 (1) (Prohibition against operating a private career college) of the Act by operating an unregistered private career college
  • Subsection 8 (1) (Prohibition against providing vocational programs) of the Act by providing a commercial truck driver (Class A) training program that had not been approved by the Superintendent
  • Subsection 9 (1) (Prohibition against charging a fee) of the Act by charging and collecting fees for a commercial truck driver (Class A) training program that had not been approved by the Superintendent; and
  • Subsection 38 (10) (Obstruction) of the Act by providing false and misleading information to designates during inquiries and examinations

Required Actions

By March 4, 2022, 6468144 Canada Inc. o/a New Baba Driving School was required by the Superintendent to provide written confirmation signed by a person with authority to bind the corporation, together with all available supporting evidence, confirming that they:

  • Had stopped operating an unregistered private career college
  • Had stopped offering and providing an unapproved commercial truck driver (Class A) training program
  • Had stopped charging and collecting fees for an unapproved commercial truck driver (Class A) training program
  • Would not hinder, obstruct or interfere with the Superintendent or designate(s) conducting an inquiry or examination by providing information relevant to the inquiry or examination that the Business knows to be false or misleading

6468144 Canada Inc. o/a New Baba Driving School provided written confirmation of its compliance to the Superintendent on February 28, 2022.
