ONTARIO REGULATION 17/07

Note: On November 29, 2021, the day subsection 3 (1) of Schedule 22 (Liquor Licence and Control Act, 2019) to the Plan to Build Ontario Together Act, 2019 comes into force, the title to the Regulation is amended by striking out “TO BREWERS RETAIL INC. AND OTHERS” at the end. (See: O. Reg. 760/21, s. 1)

Prohibition

1. No person shall transfer a container to Brewers Retail Inc., the Liquor Control Board of Ontario or an agent of Brewers Retail Inc. or the Liquor Control Board of Ontario for the purpose of receiving or attempting to receive a payment as a refund of a deposit unless a deposit on the container was collected by,

(a)  Brewers Retail Inc.;

(b)  the Liquor Control Board of Ontario or an agent of the Liquor Control Board of Ontario;

(c)  a manufacturer of beer or spirits or winery that is authorized to operate stores under clause 3 (1) (e) of the Liquor Control Act; or

(d)  a person operating a government store authorized under clause 3 (1) (e.1) of the Liquor Control Act. O. Reg. 17/07, s. 1; O. Reg. 294/15, s. 1.

Note: On November 29, 2021, the day subsection 3 (1) of Schedule 22 (Liquor Licence and Control Act, 2019) to the Plan to Build Ontario Together Act, 2019 comes into force, section 1 of the Regulation is revoked and the following substituted: (See: O. Reg. 760/21, s. 2)

Prohibition

1. No person shall transfer a container to Brewers Retail Inc., the Liquor Control Board of Ontario or an agent of Brewers Retail Inc. or the Liquor Control Board of Ontario for the purpose of receiving or attempting to receive a payment as a refund of a deposit unless a deposit on the container was collected by an operator of a retail store within the meaning of the Liquor Licence and Control Act, 2019.
