SPECIAL RULES - WATER HEATERS

Disclosure Statements
Disclosure statements — water heaters
1. For the purposes of paragraph 17 of subsection 35.1 (1) of Ontario Regulation 17/05 (General) made under the Act, the following rules apply for direct agreements in respect of water heaters:
1. If the restriction on time for performance set out in subsection 43.1 (1) of the Act applies, the following disclosure statements are required:
i. “Water Heater Contracts - What You Need to Know”, dated November 25, 2014 and available on a website of the Government of Ontario.
ii. “Mandatory Statement - if the restriction on time for performance applies”, dated November 25, 2014 and available on a website of the Government of Ontario.
2. If the restriction on time for performance set out in subsection 43.1 (1) of the Act does not apply because the circumstance prescribed by paragraph 1 of subsection 35.3 (1) of Ontario Regulation 17/05 exists, the following disclosure statements are required:
i. “Consumer-Initiated Calls Water Heater Contracts - What You Need to Know”, dated November 25, 2014 and available on a website of the Government of Ontario.
ii. “Mandatory Statement - if the restriction on time for performance does not apply”, dated November 25, 2014 and available on a website of the Government of Ontario.
3. If the restriction on time for performance set out in subsection 43.1 (1) of the Act does not apply because a circumstance prescribed by paragraph 2 or 3 of subsection 35.3 (1) of Ontario Regulation 17/05 exists, the following disclosure statements are required:
i. “Unsafe or Recalled Water Heaters - What You Need to Know”, dated November 25, 2014 and available on a website of the Government of Ontario.
ii. “Mandatory Statement - if the restriction on time for performance does not apply”, dated November 25, 2014 and available on a website of the Government of Ontario.
Provision of disclosure statements
2. (1) A supplier must provide the disclosure statements required by section 1 to the consumer at the time the agreement is entered into and the statement required by subparagraph 1 i, 2 i or 3 i of section 1, as the case may be, must be the first page of the agreement.
(2) The mandatory statement required by subparagraph 1 ii, 2 ii or 3 ii of section 1, as the case may be, must be completed by the supplier and signed by the consumer in accordance with the statement guidelines.
Verification of Agreements
Verification
3. A direct agreement that requires the supplier to supply to a consumer a water heater may be verified for the purposes of section 35.2 of Ontario Regulation 17/05 (General) made under the Act only as provided in sections 4, 5 and 6 of this Regulation.
Who may verify an agreement
4. (1) An agreement may be verified by the supplier or a representative of the supplier, but may not be verified by the same person who entered into the agreement with the consumer.
(2) A consumer may authorize a person other than the supplier or a representative of the supplier to verify an agreement on behalf of the consumer.
When an agreement may be verified
5. An agreement may be verified no later than the day that is five days before the expiry of the applicable period set out in subsection 43 (1) of the Act, but not on the same day the agreement is entered into.
Verification process
6. (1) An agreement shall be verified,
(a) only by telephone; and
(b) only with the consumer or a person that the consumer authorized to verify the agreement under subsection 4 (2).
(2) The person verifying the agreement shall follow the script set out in “Guidelines and Verification Call Script”, dated November 25, 2014 and available on a website of the Government of Ontario, and shall comply with the guidelines relating to the use of script.
(3) The person verifying the agreement shall not enter into any further agreements with the consumer or the person the consumer authorized to verify the agreement during the verification call, but shall verify all related agreements entered into at the time the agreement to supply the water heater was entered into.
(4) The supplier, or a representative of the supplier, shall not be at the residence of the consumer when the verification call is made.
(5) The supplier shall ensure that a recording of the verification call is made, and the person verifying the agreement shall advise the consumer or the person that the consumer authorized to verify the agreement that the verification call is being recorded.
(6) The supplier shall retain a recording made under subsection (5) for three years from the time the call is made.
(7) A consumer may request a copy of the verification calls made to the consumer by making a written request to the supplier, and the supplier shall, at no charge, send the copies to the consumer’s address set out in the agreement being verified, or by electronic means if the consumer requests it, within 10 days of receiving the request.
Agreement not verified
7. (1) An agreement is not verified for the purposes of section 35.2 of Ontario Regulation 17/05 (General) made under the Act if any of the following circumstances exists:
1. The consumer or the person that the consumer authorized to verify the agreement indicates that he or she is not verifying the agreement.
2. The person verifying the agreement knows or ought to know that the consumer or the person that the consumer authorized to verify the agreement is unable to understand the verification call script.
3. A verification call is not made, or the call does not meet the requirements of sections 4, 5 and 6 of this Regulation.
(2) If an agreement is not verified, the agreement is cancelled on the day of the last verification call, or if no verification call is made, on the last day that a verification call could be made under section 5.
(3) The supplier shall provide the consumer with a written notice that the agreement is cancelled and the notice shall set out the following information:
1. The date the agreement was entered into.
2. The date and time of the verification call, if any, that resulted in the agreement not being verified.
3. The name of the supplier.
