NON-APPLICATION OF SECTION 7 OF THE ACT

Non-application of s. 7 of the Act
1. (1) Section 7 of the Act does not apply with respect to a designated broadband project if the following conditions are satisfied:
1. The project owner intends to carry out all or part of the project in a local municipality with a population of less than 100,000, as reported by Statistics Canada in the most recent official census, or in Northern Ontario, as defined in subsection 5.1 (6) of the Act.
2. The affected members and the project owner have not agreed on a locater in accordance with clause 7 (7) (a) of the Act.
3. If the project owner has not given notice to the Corporation under subsection 7 (2) of the Act, the project owner has notified the Corporation at least 90 days before any excavation or dig is expected to commence that the conditions set out in paragraphs 1 and 2 are satisfied and, as a result, that section 7 of the Act does not apply with respect to the project.
4. If the project owner has given notice to the Corporation under subsection 7 (2) of the Act, the project owner has subsequently notified the Corporation and all affected members that the conditions set out in paragraphs 1 and 2 are satisfied and, as a result, that section 7 of the Act does not apply with respect to the project.
(2) For clarity, if at any time subsection (1) applies with respect to a designated broadband project, the subsection continues to apply to the project until the project has been completed.
