APPOINTMENT UNDER SECTION 218.3 OF THE ACT

Modifications to Act

1. For the purposes of implementing section 218.3 of the Act, the following modifications to the Act apply with respect to a person who is appointed as head of council under subsection 218.3 (1) of the Act:

1.  For the purposes of the application of clause 257 (a) of the Act, clause 17 (2) (a) of the Municipal Elections Act, 1996 does not apply.

2.  Clauses 258 (2) (b) and (c) of the Act do not apply.

3.  If a person is appointed as head of council to The Regional Municipality of Niagara, the following modifications to the Act apply:

i.  Subsection 263 (1) of the Act shall be read as follows:

Filling vacancies

263. (1) If a vacancy occurs in the office of a member of council of The Regional Municipality of Niagara, the municipality shall, subject to this section, fill the vacancy by appointing a person who has consented to accept the office if appointed.

ii.  Paragraph 1 of subsection 263 (5) of the Act shall be read as follows:

1.  Within 60 days after the day the Minister provides a copy of the order made under subsection 218.3 (1) to The Regional Municipality of Niagara, the municipality shall appoint a person to fill the vacancy under subsection (1).
