Accommodation Sector Registration of Guests Act, 2021

GENERAL

Note: THIS REGULATION IS NOT YET IN FORCE. It comes into force on January 1, 2026, the day section 7 of Schedule 1 (Accommodation Sector Registration of Guests Act, 2021) to the Combating Human Trafficking Act, 2021 comes into force.

Definitions

1. In this Regulation,

“online accommodation platform” means an electronic marketplace that brokers or facilitates reservations for short-term accommodation and receives payment for this service; (“plateforme d’hébergement en ligne”)

“short-term accommodation” is rental accommodation in all or part of a residential property for a period of less than 28 consecutive days. (“hébergement de courte durée”)

Register, hotels

2. (1) For the purposes of paragraph 3 of subsection 2 (2) of the Act, the following information must be recorded in a hotel’s register:

1. The primary phone number of the guest who provides their name and primary residence.

2. The make, model and licence plate number, including the jurisdiction that issued the licence plate, of any guest’s vehicle that will be parked on the grounds of the hotel.

(2) For the purposes of subsection 2 (3) of the Act, the information referred to in that subsection and in subsection (1) of this Regulation shall be maintained in the register until the end of the sixth year after the fiscal period in which the information was recorded.

Register, online accommodation platforms

3. (1) For the purposes of subsection 3 (1) of the Act, online accommodation platforms are prescribed as a class of owner or operator of a business that shall maintain a register.

(2) The owner or operator of an online accommodation platform shall maintain the following information in a register every time a person reserves short-term accommodation through an online accommodation platform:

1. The name, billing address and primary phone number of the person who reserves the short-term accommodation.

2. The make, model and licence plate number, including the jurisdiction that issued the licence plate, of any guest’s vehicle that will be parked on the grounds of the residential property where the short-term accommodation is provided, unless the information is unknown at the time the reservation is made.

Urgent demand report

4. For the purposes of subsection 4 (5) of the Act, the timeframe within which a written report must be provided in accordance with that subsection is 30 days.

Annual report

5. (1) For the purposes of subsection 5 (1) of the Act, the date on or before which an annual report must be provided in accordance with that subsection is April 1 in each year.

(2) The annual report required by subsection 5 (1) of the Act must be provided in a format approved by the Minister.

(3) For the purposes of clause 5 (2) (b) of the Act, the board or entity that receives the annual report shall make it available to the public by posting it on a website on or before June 1 in the year the report is received.

(4) For the purposes of subsection 5 (3) of the Act, the Solicitor General shall make the annual report available to the public by posting it on a website of the Government of Ontario on or before June 1 in the year the report is received.
