DISPOSITION OF REAL PROPERTY

Note: THIS REGULATION IS NOT YET IN FORCE. It comes into force on April 1, 2026, the day subsection 4 (5) of Schedule 27 to the Cutting Red Tape, Building Ontario Act, 2024 comes into force.

Prescribed circumstances for disposition

1. For the purposes of subsection 16 (4) of the Act, the following is a prescribed circumstance:

1. The disposition is required to support the construction, operation or maintenance of a provincial transit project and the disposition affects any of the following:

i. Transit or transportation infrastructure constructed along a defined corridor or alignment, including rail tracks, guideways, train control and signalling systems, traction power systems, stations and platforms, grade separations, road modifications, utility relocations, drainage works and related works and any access infrastructure required to construct, operate or maintain such transit or transportation infrastructure.

ii. Infrastructure owned, operated or maintained by a municipality, including roads, highways, bridges, sidewalks, cycling facilities, water and wastewater systems, stormwater management facilities, street lighting, traffic control systems and public utilities and any related structures or appurtenances required for the construction, relocation, operation or maintenance of such infrastructure.

iii. Infrastructure used for the transmission, distribution or provision of electricity, natural gas, telecommunications, cable services, water, wastewater and stormwater services, including poles, wires, conduits, ducts, pipes, mains, sewers, vaults, chambers and meters and any related equipment or appurtenances required for the installation, relocation, operation, protection or maintenance of such infrastructure.
