WASTE DISPOSAL SITES, WASTE MANAGEMENT SYSTEMS AND SEWAGE WORKS SUBJECT TO APPROVAL UNDER OR EXEMPT FROM THE ENVIRONMENTAL ASSESSMENT ACT

1. A waste disposal site, waste management system or sewage works is exempt from being the subject matter of a hearing under section 20.15 of the Environmental Protection Act if it is or forms part of an undertaking or project that,
(a) is subject to Part II.3 of the Environmental Assessment Act; or
(b) is subject to Part II.1 of the Environmental Assessment Act under section 15 of that Act. O. Reg. 206/97, s. 1; O. Reg. 247/11, s. 2; O. Reg. 62/24, s. 1.
Note: On January 1, 2027, section 1 of the Regulation is revoked and the following substituted: (See: O. Reg. 264/26, s. 1)
Exempt from hearing
1. (1) A waste disposal site, waste management system or sewage works is exempt from being the subject matter of a hearing under section 20.15 of the Environmental Protection Act if it is or forms part of an undertaking or project that is subject to Part II.1, II.3 or II.4 of the Environmental Assessment Act. (2) Subsection (1) does not apply in respect of a sewage works that is designated as a Part II.4 project under section 35 or 37 of Ontario Regulation 50/24 (Designation of Part II.3 and II.4 Projects). O. Reg. 264/26, s. 1.
