Amending O. Reg. 176/10

(TEACHERS' QUALIFICATIONS)

1. Section 6 of Ontario Regulation 176/10 is amended by adding “or previously held” after “holds” in the portion before clause (a).

2. Subsection 11 (1) of the Regulation is revoked and the following substituted:

Applicants under s. 4 (1) or 6

(1) The Registrar may grant to an applicant under subsection 4 (1) or section 6 a general certificate of qualification and registration if the Registrar has satisfactory evidence that the applicant has,

(a) complied with subsection 4 (3) or section 6, as the case may be, and section 9;

(b) met the requirements set out in subsection (2), (3), (4), (5) or (5.1); and

(c) paid all fees required under the by-laws for the issuance of the certificate.

3. Subsection 12 (1) of the Regulation is amended by striking out “and” at the end of clause (c) and by adding the following clause:

(c.1) the applicant has paid all fees required under the by-laws for the issuance of the certificate; and

4. Section 13 of the Regulation is amended by adding the following clause:

(a.1) the applicant has paid all fees required under the by-laws for the issuance of the certificate;

5. Subsection 13.1 (1) of the Regulation is revoked and the following substituted:

Applicants under s. 6.1 (resignation)

(1) The Registrar may grant to an applicant under section 6.1 a general certificate of qualification and registration if the Registrar has satisfactory evidence that the applicant has,

(a) complied with sections 6.1 and 9;

(b) met any applicable requirements set out in subsection (2) or (3); and

(c) paid all fees required under the by-laws for the issuance of the certificate.

6. Subsection 13.2 (1) of the Regulation is revoked and the following substituted:

Applicants under s. 6.2 ­(expiry)

(1) The Registrar may grant to an applicant under section 6.2 a general certificate of qualification and registration if the Registrar has satisfactory evidence that the applicant has,

(a) complied with sections 6.2 and 9;

(b) met any applicable requirements set out in subsection (2) or (3); and

(c) paid all fees required under the by-laws for the issuance of the certificate.

7. Subsection 14 (1) of the Regulation is revoked and the following substituted:

Applicants under s. 4

(1) The Registrar may grant to an applicant under section 4 a transitional certificate of qualification and registration, valid for six years, if the Registrar has satisfactory evidence that the applicant has not previously held a transitional certificate of qualification and registration and the applicant has,

(a) complied with sections 4 and 9;

(b) met the requirements set out in subsection (2), (3), (4), (5) or (6); and

(c) paid all fees required under the by-laws for the issuance of the certificate.

8. Section 15 of the Regulation is amended by adding the following clause:

(a.1) the applicant has paid all fees required under the by-laws for the issuance of the certificate;

9. The Regulation is amended by adding the following section:

Old qualification name

41.1 If any member’s certificate of qualification and registration includes an entry for a qualification that refers to teaching the trainable retarded or teaching trainable retarded children, the Registrar shall amend the name of the qualification so that it refers to teaching students with intellectual disabilities.

10. Section 49 of the Regulation is revoked and the following substituted:

2016 amendments

49. Any person who, on August 31, 2016, holds a qualification that is set out in Column 2 of the Table to this section is deemed, on and after September 1, 2016, to hold the qualification set out in the corresponding cell of Column 3 of the Table.
