Amending O. Reg. 49/01
(DESCRIPTION AND REGISTRATION)
1. Subsection 2 (6) of Ontario Regulation 49/01 is revoked and the following substituted:
(6) In the case of a phased condominium corporation and sheets of the plans of survey, each item of information described in clauses (4) (a), (b) and (c) shall be placed in a row in a table under a column labelled “Sheet/Part” or “Feuille/partie” and the corresponding date for each item shall be set out opposite it in an adjacent column labelled “Date”.
2. Subsection 8 (5) of the Regulation is revoked and the following substituted:
(5) Subject to subsection (4), the limits of units, common elements and exclusive use portions shall be shown on the plans of survey by solid lines that are significantly heavier than the lines described in section 21 of Ontario Regulation 216/10 (Performance Standards for the Practice of Professional Land Surveying) made under the Surveyors Act.
3. Section 9 of the Regulation is revoked and the following substituted:

9. (1) Sections 8 to 13, clauses 18 (1) (a) to (f), subsection 18 (2) and sections 20 to 30 of Ontario Regulation 216/10 (Performance Standards for the Practice of Professional Land Surveying) made under the Surveyors Act do not apply to the diagrams of the units as described in clause 8 (1) (d) of the Act or to the exclusive use portions survey.
(2) Despite subsection (1), clauses 18 (1) (b) and (c), subsection 18 (2) and sections 20 and 24 of Ontario Regulation 216/10 (Performance Standards for the Practice of Professional Land Surveying) made under the Surveyors Act apply to the diagrams of the units as described in clause 8 (1) (d) of the Act or to the exclusive use portions survey if the boundaries of the units or exclusive use portions, as the case may be, are located six metres or more from a building situated on the property.
4. Subclause 28 (3) (c) (i) of the Regulation is amended by adding “as it read immediately before the repeal of that Act” after “Certification of Titles Act”.

5. This Regulation comes into force on the day it is filed.
