Amending O. Reg. 134/98
(GENERAL)
1. The definition of “dependant” in subsection 1 (1) of Ontario Regulation 134/98 is amended by striking out “or” at the end of clause subclause (a) (iii), adding “or” at the end of clause (b) and adding the following clause:
(c) a dependent child who is absent from the dwelling place of the applicant or recipient as a result of the involvement of a children’s aid society and the absence is expected to be temporary;
2. Subsection 2 (3) of the Regulation is amended by adding “and” at the end of clause (c) and by revoking clause (d).
3. (1) Subsection 10 (1) of the Regulation is amended by adding “and” at the end of clause (b) and by revoking clause (c).
(2) Subsections 10 (3), (4) and (5) of the Regulation are revoked.
4. Section 47.2 of the Regulation is amended by adding the following subsection:
(6) In the case of a retroactive payment that applies to a period after June 30, 2016, item “D” in the formula set out in subsection (2) shall equal the total payment with respect to dependent children that would have been made with respect to item “C” in the formula set out in subsection 122.61 (1) of the Income Tax Act (Canada), as if that subsection, as it read on July 1, 2016, applied.
5. Section 53 of the Regulation is amended by adding the following paragraph:
4.2 A disabled contributor’s child’s benefit payment under the Canada Pension Plan.
6. (1) Subsection 54 (1) of the Regulation is amended by adding the following paragraph:
33. A disabled contributor’s child’s pension payment under the Act Respecting the Quebec Pension Plan (Quebec).
(2) Subsection 54 (1) of the Regulation is amended by adding the following paragraph:
34. A fee or allowance paid for attendance as a juror.
7. Paragraph 1 of subsection 55 (1) of the Regulation is amended by adding the following subparagraph:
ii.1 the cost of dental services for,
A. in the case of a recipient who is resident in a territory that is designated as a geographic area under section 2, 2.1, 2.2, 2.3, 2.4, 2.5 or 2.6 of Ontario Regulation 136/98 (Designation of Geographic Areas and Delivery Agents) made under the Act, members of the recipient’s benefit unit who are younger than 18 years of age, if those services and that cost have been approved by the Minister, and
B. children who are resident in a territory referred to in sub-subparagraph A and on whose behalf temporary care assistance is provided pursuant to section 57, if those services and that cost have been approved by the Minister,
8. Section 58.3 of the Regulation is amended by adding the following subsection:
(5) When calculating a transition child benefit payment that applies to a period after June 30, 2016, a reference to an amount in respect of item “C” in the formula set out in subsection 122.61 (1) of the Income Tax Act (Canada) shall be read as an amount that would have been determined in respect of item “C” in the formula set out in that subsection as if that subsection, as it read on July 1, 2016, applied.
Commencement
9. (1) Subject to subsections (2), (3), (4) and (5), this Regulation comes into force on the day it is filed.
(2) Subsection 6 (2) is deemed to have come into force on September 1, 2017.
(3) Section 5 and subsection 6 (1) are deemed to have come into force on October 1, 2017.
(4) Section 7 comes into force on January 1, 2018.
(5) Sections 2 and 3 come into force on March 1, 2018.
