Amending O. Reg. 325/18

(PLACES OF CONSUMPTION)

1. (1) Clause 3 (c) of Ontario Regulation 325/18 is amended by striking out “subsection 13 (2) of the Smoke-Free Ontario Act, 2017” at the end and substituting “subsection 9 (10) of the Smoke-Free Ontario Act”.

(2) Clause 3 (c) of the Regulation, as amended by subsection (1), is amended by striking out “subsection 9 (10) of the Smoke-Free Ontario Act” at the end and substituting “subsection 13 (2) of the Smoke-Free Ontario Act, 2017”.

2. (1) Subsection 4 (2) of the Regulation is amended by striking out “subsection 16 (4) of the Smoke-Free Ontario Act, 2017” and substituting “subsection 9.1 (5) of the Smoke-Free Ontario Act”.

(2) Subsection 4 (2) of the Regulation, as amended by subsection (1), is amended by striking out “subsection 9.1 (5) of the Smoke-Free Ontario Act” and substituting “subsection 16 (4) of the Smoke-Free Ontario Act, 2017”.

3. (1) Section 5 of the Regulation is revoked and the following substituted:

Exemptions for workplaces that are other types of residences

5. (1) Subsection 11 (1) of the Act does not apply to the consumption of cannabis by smoking or through the use of an electronic cigarette in an indoor room that is exempted from subsection 9 (1) of the Smoke-Free Ontario Act under subsection 9 (7), (8) or (9) of that Act.

(2) In the case of the consumption of cannabis in a manner other than by smoking or through the use of an electronic cigarette, subsection 11 (1) of the Act does not apply to a workplace that is,

(a) a residence under paragraph 1 of subsection 9 (7) of the Smoke-Free Ontario Act;

(b) a designated psychiatric facility under paragraph 1 of subsection 9 (8) of that Act; or

(c) a designated facility for veterans under paragraph 1 of subsection 9 (9) of that Act.

(2) Section 5 of the Regulation, as remade by subsection (1), is revoked and the following substituted:

5. (1) Subsection 11 (1) of the Act does not apply to the consumption of cannabis by smoking or through the use of an electronic cigarette in any room in a workplace listed in paragraph 1 of subsection 13 (1) of the Smoke-Free Ontario Act, 2017, if the room meets the conditions listed in paragraphs 2 to 5 of subsection 13 (1) of that Act.

(2) In the case of the consumption of cannabis in a manner other than by smoking or through the use of an electronic cigarette, subsection 11 (1) of the Act does not apply to a workplace listed in paragraph 1 of subsection 13 (1) of the Smoke-Free Ontario Act, 2017.

4. (1) Subsection 7 (2) of the Regulation is amended by striking out “In addition to any prohibitions or restrictions on consumption set out under the Smoke-Free Ontario Act, 2017” at the beginning.

(2) Subsection 7 (2) of the Regulation, as amended by subsection (1), is amended by adding “In addition to any prohibitions or restrictions on consumption set out under the Smoke-Free Ontario Act, 2017” at the beginning.

5. Section 9 of the Regulation is revoked and the following substituted:

Commencement

9. (1) Subject to subsection (2), this Regulation comes into force on the day subsection 11 (1) of Schedule 1 (Cannabis Act, 2017) to the Cannabis, Smoke-Free Ontario and Road Safety Statute Law Amendment Act, 2017 comes into force.

(2) Section 6 comes into force on the later of the day subsection 11 (1) of Schedule 1 (Cannabis Act, 2017) to the Cannabis, Smoke-Free Ontario and Road Safety Statute Law Amendment Act, 2017 comes into force and the day section 29 of Schedule 3 (Smoke-Free Ontario Act, 2017) to the Cannabis, Smoke-Free Ontario and Road Safety Statute Law Amendment Act, 2017 comes into force.

Commencement

6. (1) Subject to subsections (2) and (3), this Regulation comes into force on the later of the day subsection 11 (1) of Schedule 1 (Cannabis Act, 2017) to the Cannabis, Smoke-Free Ontario and Road Safety Statute Law Amendment Act, 2017 comes into force and the day it is filed.

(2) Subsections 1 (2), 2 (2), 3 (2) and 4 (2) come into force on the latest of the following days:

1. The day subsection 11 (1) of Schedule 1 (Cannabis Act, 2017) to the Cannabis, Smoke-Free Ontario and Road Safety Statute Law Amendment Act, 2017 comes into force.

2. The day section 29 of Schedule 3 (Smoke-Free Ontario Act, 2017) to the Cannabis, Smoke-Free Ontario and Road Safety Statute Law Amendment Act, 2017 comes into force.

3. The day this Regulation is filed.

(3) Section 5 comes into force on the day this Regulation is filed.
