Amending O. Reg. 19/15

(FEES, ALLOWANCES AND FORMS)

1. Section 4 of Ontario Regulation 19/15 is revoked and the following substituted:

Post mortem examinations, etc.

4. The fees and allowances set out in Schedule 3 are payable for,

(a) a post mortem examination of a body;

(b) any other examination or analysis;

(c) the use of facilities for post mortem examination in a hospital or other place; and

(d) travel in connection with an examination or analysis.

Transporting a dead body

4.1 The fees and allowances set out in Schedule 4 are payable for transporting a dead body or bodies for further investigation upon the authorization of a coroner.

2. Section 5 of the Regulation is amended by striking out “Schedules 1, 2 and 3” and substituting “Schedules 1, 2, 3 and 4”.

3. (1) Schedule 3 to the Regulation is amended by adding the following paragraph:

10.1 If the transportation of a dead body necessarily requires the use of a body pouch, a fee of $35 per required pouch.

(2) Paragraphs 8 to 13 of Schedule 3 to the Regulation, as amended by subsection (1), are revoked and the following substituted:

8. For each kilometre of necessary travel by private automobile by a legally qualified medical practitioner in connection with an examination or analysis, a travel allowance of 41 cents per kilometre in northern Ontario and 40 cents per kilometre in southern Ontario.

4. (1) The Regulation is amended by adding the following Schedule:

Schedule 4
Transporting a Dead Body or Bodies

1. If two attendants transport a dead body for further investigation on the authorization of the coroner, a fee that is the greater of,

i. a flat fee of $282.71, or

ii. an allowance for necessary travel to pick up the dead body, deliver it and return it to the place of origin, calculated at the rate of,

A. in southern Ontario, $2.31 per kilometre, and

B. in northern Ontario, $2.39 per kilometre.

2. The fee mentioned in paragraph 1 may be increased by the Chief Coroner to an amount that he or she considers appropriate if, in his or her opinion, the increase is justified having regard to the special circumstances of the case.

3. If more than one dead body is transported on the same trip for further investigation on the authorization of the coroner, a fee for each additional dead body of $28.27.

4. If the transportation of a dead body or bodies necessarily requires the use of more than two attendants,

i. an additional fee of $85 per additional attendant beyond the first two, and

ii. an additional allowance for necessary travel of the additional attendant or attendants to the location or locations where they provide services, calculated at the rate of,

A. in southern Ontario, 40 cents per kilometre per additional vehicle required, and

B. in northern Ontario, 41 cents per kilometre per additional vehicle required.

5. If the transportation of a dead body or bodies necessarily requires the use of a body pouch, a fee of $38.85 per required pouch.

6. For waiting time in excess of one-half hour necessarily incurred in connection with the transportation of a dead body or bodies, a fee of,

i. $28.27 per hour, to a maximum of eight hours, in the case of a single attendant, or

ii. $56.54 per hour, to a maximum of eight hours, in the case of two or more attendants.

7. If the transportation of a dead body or bodies necessarily requires the attendant or attendants to seek overnight accommodation, an allowance of $300 per night for accommodation and related expenses.

8. If the coroner approves of the transportation of a dead body or bodies by means other than a motor vehicle,

i. a fee equal to the amount paid for the transportation of the dead body or bodies, and

ii. in the case of transportation by air, an additional administrative fee of $85.

9. If the transportation of a dead body or bodies necessarily requires overnight storage of the body or bodies, a fee of $85 per body per night.

(2) Schedule 4 to the Regulation, as made by subsection (1), is revoked and the following substituted:

1. If two attendants transport a dead body for further investigation on the authorization of the coroner, a fee that is the greater of,

i. a flat fee of $288.36, or

ii. an allowance for necessary travel to pick up the dead body, deliver it and return it to the place of origin, calculated at the rate of,

A. in southern Ontario, $2.35 per kilometre, and

B. in northern Ontario, $2.43 per kilometre.

2. The fee mentioned in paragraph 1 may be increased by the Chief Coroner to an amount that he or she considers appropriate if, in his or her opinion, the increase is justified having regard to the special circumstances of the case.

3. If more than one dead body is transported on the same trip for further investigation on the authorization of the coroner, a fee for each additional dead body of $28.84.

4. If the transportation of a dead body or bodies necessarily requires the use of more than two attendants,

i. an additional fee of $86.70 per additional attendant beyond the first two, and

ii. an additional allowance for necessary travel of the additional attendant or attendants to the location or locations where they provide services, calculated at the rate of,

A. in southern Ontario, 40 cents per kilometre per additional vehicle required, and

B. in northern Ontario, 41 cents per kilometre per additional vehicle required.

5. If the transportation of a dead body or bodies necessarily requires the use of a body pouch, a fee of $39.63 per required pouch.

6. For waiting time in excess of one-half hour necessarily incurred in connection with the transportation of a dead body or bodies, a fee of,

i. $28.84 per hour, to a maximum of eight hours, in the case of a single attendant, or

ii. $57.67 per hour, to a maximum of eight hours, in the case of two or more attendants.

7. If the transportation of a dead body or bodies necessarily requires the attendant or attendants to seek overnight accommodation, an allowance of $300 per night for accommodation and related expenses.

8. If the coroner approves of the transportation of a dead body or bodies by means other than a motor vehicle,

i. a fee equal to the amount paid for the transportation of the dead body or bodies, and

ii. in the case of transportation by air, an additional administrative fee of $86.70.

9. If the transportation of a dead body or bodies necessarily requires overnight storage of the body or bodies, a fee of $86.70 per body per night.

(3) Schedule 4 to the Regulation, as remade by subsection (2), is revoked and the following substituted:

1. If two attendants transport a dead body for further investigation on the authorization of the coroner, a fee that is the greater of,

i. a flat fee of $294.13, or

ii. an allowance for necessary travel to pick up the dead body, deliver it and return it to the place of origin, calculated at the rate of,

A. in southern Ontario, $2.40 per kilometre, and

B. in northern Ontario, $2.48 per kilometre.

2. The fee mentioned in paragraph 1 may be increased by the Chief Coroner to an amount that he or she considers appropriate if, in his or her opinion, the increase is justified having regard to the special circumstances of the case.

3. If more than one dead body is transported on the same trip for further investigation on the authorization of the coroner, a fee for each additional dead body of $29.41.

4. If the transportation of a dead body or bodies necessarily requires the use of more than two attendants,

i. an additional fee of $88.43 per additional attendant beyond the first two, and

ii. an additional allowance for necessary travel of the additional attendant or attendants to the location or locations where they provide services, calculated at the rate of,

A. in southern Ontario, 40 cents per kilometre per additional vehicle required, and

B. in northern Ontario, 41 cents per kilometre per additional vehicle required.

5. If the transportation of a dead body or bodies necessarily requires the use of a body pouch, a fee of $40.42 per required pouch.

6. For waiting time in excess of one-half hour necessarily incurred in connection with the transportation of a dead body or bodies, a fee of,

i. $29.41 per hour, to a maximum of eight hours, in the case of a single attendant, or

ii. $58.83 per hour, to a maximum of eight hours, in the case of two or more attendants.

7. If the transportation of a dead body or bodies necessarily requires the attendant or attendants to seek overnight accommodation, an allowance of $300 per night for accommodation and related expenses.

8. If the coroner approves of the transportation of a dead body or bodies by means other than a motor vehicle,

i. a fee equal to the amount paid for the transportation of the dead body or bodies, and

ii. in the case of transportation by air, an additional administrative fee of $88.43.

9. If the transportation of a dead body or bodies necessarily requires overnight storage of the body or bodies, a fee of $88.43 per body per night.

(4) Schedule 4 to the Regulation, as remade by subsection (3), is revoked and the following substituted:

i. a flat fee of $300.01, or

ii. an allowance for necessary travel to pick up the dead body, deliver it and return it to the place of origin, calculated at the rate of,

A. in southern Ontario, $2.45 per kilometre, and

B. in northern Ontario, $2.53 per kilometre.

2. The fee mentioned in paragraph 1 may be increased by the Chief Coroner to an amount that he or she considers appropriate if, in his or her opinion, the increase is justified having regard to the special circumstances of the case.

3. If more than one dead body is transported on the same trip for further investigation on the authorization of the coroner, a fee for each additional dead body of $30.

4. If the transportation of a dead body or bodies necessarily requires the use of more than two attendants,

i. an additional fee of $90.20 per additional attendant beyond the first two, and

ii. an additional allowance for necessary travel of the additional attendant or attendants to the location or locations where they provide services, calculated at the rate of,

A. in southern Ontario, 40 cents per kilometre per additional vehicle required, and

B. in northern Ontario, 41 cents per kilometre per additional vehicle required.

5. If the transportation of a dead body or bodies necessarily requires the use of a body pouch, a fee of $41.23 per required pouch.

6. For waiting time in excess of one-half hour necessarily incurred in connection with the transportation of a dead body or bodies, a fee of,

i. $30 per hour, to a maximum of eight hours, in the case of a single attendant, or

ii. $60 per hour, to a maximum of eight hours, in the case of two or more attendants.

7. If the transportation of a dead body or bodies necessarily requires the attendant or attendants to seek overnight accommodation, an allowance of $300 per night for accommodation and related expenses.

8. If the coroner approves of the transportation of a dead body or bodies by means other than a motor vehicle,

i. a fee equal to the amount paid for the transportation of the dead body or bodies, and

ii. in the case of transportation by air, an additional administrative fee of $90.20.

9. If the transportation of a dead body or bodies necessarily requires overnight storage of the body or bodies, a fee of $90.20 per body per night.

(5) Schedule 4 to the Regulation, as remade by subsection (4), is revoked and the following substituted:

1. If two attendants transport a dead body for further investigation on the authorization of the coroner, a fee that is the greater of,

i. a flat fee of $306.01, or

ii. an allowance for necessary travel to pick up the dead body, deliver it and return it to the place of origin, calculated at the rate of,

A. in southern Ontario, $2.50 per kilometre, and

B. in northern Ontario, $2.58 per kilometre.

2. The fee mentioned in paragraph 1 may be increased by the Chief Coroner to an amount that he or she considers appropriate if, in his or her opinion, the increase is justified having regard to the special circumstances of the case.

3. If more than one dead body is transported on the same trip for further investigation on the authorization of the coroner, a fee for each additional dead body of $30.60.

4. If the transportation of a dead body or bodies necessarily requires the use of more than two attendants,

i. an additional fee of $92.01 per additional attendant beyond the first two, and

ii. an additional allowance for necessary travel of the additional attendant or attendants to the location or locations where they provide services, calculated at the rate of,

A. in southern Ontario, 40 cents per kilometre per additional vehicle required, and

B. in northern Ontario, 41 cents per kilometre per additional vehicle required.

5. If the transportation of a dead body or bodies necessarily requires the use of a body pouch, a fee of $42.05 per required pouch.

6. For waiting time in excess of one-half hour necessarily incurred in connection with the transportation of a dead body or bodies, a fee of,

i. $30.60 per hour, to a maximum of eight hours, in the case of a single attendant, or

ii. $61.20 per hour, to a maximum of eight hours, in the case of two or more attendants.

7. If the transportation of a dead body or bodies necessarily requires the attendant or attendants to seek overnight accommodation, an allowance of $300.00 per night for accommodation and related expenses.

8. If the coroner approves of the transportation of a dead body or bodies by means other than a motor vehicle,

i. a fee equal to the amount paid for the transportation of the dead body or bodies, and

ii. in the case of transportation by air, an additional administrative fee of $92.01.

9. If the transportation of a dead body or bodies necessarily requires overnight storage of the body or bodies, a fee of $92.01 per body per night.

Commencement

5. (1) Subject to subsections (2) to (6), this Regulation comes into force on the day it is filed.

(2) Sections 1 and 2 and subsections 3 (2) and 4 (1) come into force on the later of June 1, 2019 and the day this Regulation is filed.

(3) Subsection 4 (2) comes into force on April 1, 2020.

(4) Subsection 4 (3) comes into force on April 1, 2021.

(5) Subsection 4 (4) comes into force on April 1, 2022.

(6) Subsection 4 (5) comes into force on April 1, 2023.
