Amending Reg. 628 of R.R.O. 1990

(VEHICLE PERMITS)

1. (1) Subsection 18 (4) of Regulation 628 of the Revised Regulations of Ontario, 1990 is amended by adding the following paragraph:

3.  If the validation period is more than 24 months, an amount equal to three times the applicable annual fee for the appropriate permit number set out in Schedule 4.

(2) Section 18 of the Regulation is amended by adding the following subsections:

(4.1) If the validity of a permit was extended or continued under subsection 2 (3) or (4) of Ontario Regulation 45/20 (Extending Time Periods in Ontario Regulations) made under the Act for one year or longer and the permit was not renewed before March 1, 2021, then the next time the permit is renewed, the permit shall be validated until,

(a)  the next anniversary of the original expiry date; or

(b)  the next anniversary after that.

(4.2) Upon validation of a permit under subsection (4.1), the following fees shall be paid to the Ministry:

1.  For a permit that is validated for the term described in clause (4.1) (a), twice the applicable annual fee for the appropriate permit number set out in Schedule 4.

2.  For a permit that is validated for the term described in clause (4.1) (b), three times the applicable annual fee for the appropriate permit number set out in Schedule 4.

(6.0.1) Subsections (5) and (6) apply with necessary modifications to a person to whom subsection (4.1) applies.

(3) Subsections 18 (4.1), (4.2) and (6.0.1) of the Regulation, as made by subsection (2), are revoked.

2. (1) The Regulation is amended by adding the following sections:

19.1 (1) This section applies to a motor vehicle permit of a class referred to in section 19 if the permit was extended or continued under section 2 (3) or (4) of Ontario Regulation 45/20 (Extending Time Periods in Ontario Regulations) made under the Act and the permit was not renewed before March 1, 2021.

(2) When a permit to which this section applies is next renewed,

(a)  the period from March 1, 2021 to the date of the renewal shall be deemed to be included in the validation period under subsection 5 (2), and fees shall be payable in respect of the entire validation period; and

(b)  subject to subsection (3), a fee calculated according to the following formula, and rounded up to the nearest dollar, shall be payable in addition to the fees referred to in clause (a):

in which,

  “A”  is the number of consecutive months before March 1, 2021 for which the vehicle permit was extended or continued under subsection 2 (3) or (4) of Ontario Regulation 45/20 (Extending Time Periods in Ontario Regulations), and

  “B”  is the annual fee set out in Schedule 1, 2 or 3 that would have applied to that vehicle if the permit had been renewed by the permit holder after its last expiry before March 1, 2021.

(3) No fee is payable under clause (2) (b) for a calendar month if,

(a)  prior to the start of the month, the permit holder surrendered the number plates to the Ministry or applied to the Ministry to remove the number plates from the vehicle; or

(b)  the vehicle was not operated during the entire month and the permit holder applies to the Ministry for an exemption for the month at the time of renewing the permit.

(4) Subsection (3) applies in respect of more than one calendar month only if the months are consecutive.

(5) A permit holder who is granted an exemption under clause (3) (b) shall retain documentation and information demonstrating they satisfied the condition in that clause for a period of two years from the date of renewal and shall provide it upon request of the Ministry.

(6) If a permit holder receives an exemption under clause (3) (b) and fails to comply with subsection (5) or if the Ministry determines that the permit holder provided false or inaccurate documentation or information relating to the exemption, the Ministry may add the fees that were exempted to the validation fee for any permit of the permit holder.

(7) The Ministry may enter into an instalment payment plan with a permit holder to provide for the payment of fees payable under clause (2) (b).

(8) The fees referred to in subsection (7) are payable,

(a)  if the permit holder has entered into a payment plan, on the dates set out in that plan; and

(b)  if the permit holder has not entered into a payment plan, on the deadline that the Ministry has set for entering into a payment plan.

(9) The payment plan shall require that all such fees,

(a)  be paid no later than the second anniversary of the day section 2 of Ontario Regulation 45/20 (Extending Time Periods in Ontario Regulations) made under the Act is revoked; and

(b)  become payable immediately upon a failure to comply with any provision of the payment plan.

19.2 (1) Section 19.1 does not apply to an IRP cab card.

(2) This section applies to an IRP cab card if the validation of the IRP cab card was extended or continued under subsection 2 (3) or (4) of Ontario Regulation 45/20 (Extending Time Periods in Ontario Regulations) made under the Act and the holder of the IRP cab card did not renew the cab card before March 1, 2021.

(3) The Ministry may enter into an instalment payment plan with the holder of an IRP cab card to provide for the payment of the Ontario portion of IRP cab card fees owing for the time period between March 1, 2020 and February 28, 2021.

(4) The fees referred to in subsection (3) are payable,

(a)  if the permit holder has entered into a payment plan, on the dates set out in that plan; and

(b)  if the permit holder has not entered into a payment plan, on the deadline that the Ministry has set for entering into a payment plan.

(5) The payment plan shall require that all such fees,

(a)  be paid no later than the second anniversary of the day section 2 of Ontario Regulation 45/20 (Extending Time Periods in Ontario Regulations) is revoked; and

(b)  become payable immediately upon a failure to comply with any provision of the payment plan.

(2) Sections 19.1 and 19.2 of the Regulation, as made by subsection (1), are revoked.

Commencement

3. (1) Subject to subsections (2) and (3), this Regulation comes into force on the later of March 1, 2021 and the day it is filed.

(2) Subsection 1 (3) comes into force on April 1, 2022.

(3) Subsection 2 (2) comes into force on September 1, 2023.
