Amending O. Reg. 53/01
(BILINGUAL PROCEEDINGS)
1. Section 1 of Ontario Regulation 53/01 and the heading before section 1 are revoked.
2. Section 2 of the Regulation and the heading before section 2 are revoked.
3. (1) Subsection 3 (1) of the Regulation is amended by adding “who speaks French” after “a party to a proceeding” in the portion before clause (a).
(2) Subsection 3 (4) of the Regulation is revoked.
4. Subclause 5 (1) (a) (i) of the Regulation is amended by striking out “March 2017” and substituting “August 2021”.
5. Section 5.1 of the Regulation is revoked.
6. (1) Subsection 7 (1) of the Regulation is amended by adding “who speaks French” after “a party to the appeal”.
(2) Subsection 7 (4) of the Regulation is revoked.
7. Subsection 8 (1) of the Regulation is amended by striking out “March 2017” in the portion before clause (a) and substituting “August 2021”.
8. Section 8.1 of the Regulation is revoked.
9. Section 11 of the Regulation is amended by adding the following subsection:
(2) Subsection (1) does not apply with respect to a proceeding if paragraph 23.2 (2) (d) of the Divorce Act (Canada) applies with respect to the proceeding.
10. Clause 12 (a) of the Regulation is amended by striking out “paragraph 9” and substituting “paragraph 6”.
11. Section 14 of the Regulation is amended by striking out “126 (7)” and substituting “126 (3)”.
12. (1) The Regulation is amended by striking out “126 (1)” and “126 (2)” wherever they appear and substituting in each case “126 (4)”.
(2) The Regulation is amended by striking out “126 (3)” wherever it appears, except in section 14, and substituting in each case “126 (7)”.
Commencement
13. This Regulation comes into force on the later of the day section 16 of Schedule 3 to the Accelerating Access to Justice Act, 2021 comes into force and the day this Regulation is filed.
