Amending O. Reg. 364/20

(RULES FOR AREAS AT STEP 3 AND AT THE ROADMAP EXIT STEP)

1. (1) Subsection 2.1 (6) of Schedule 1 to Ontario Regulation 364/20 is amended by adding “or” at the end of clause (d), by striking out “or” at the end of clause (e), and by revoking clause (f).

(2) Subsection 2.2 (5) of Schedule 1 to the Regulation is amended by adding the following paragraph:

2.1 Indoor recreational amenities.

(3) Subsections 3 (1) and (2) of Schedule 1 to the Regulation are revoked and the following substituted:

Capacity limits for indoor businesses or facilities

(1) Subject to any other requirements set out in this Order with respect to capacity limits, the person responsible for a place of business or facility that is open to the public and that is operating in an indoor setting shall limit the number of members of the public in the place of business or facility so that the members of the public are able to maintain a physical distance of at least two metres from every other person in the business or facility.

(4) Schedule 1 to the Regulation is amended by adding the following section:

Capacity limits for outdoor businesses or facilities

3.0.1 For the purposes of this Order, the maximum number of members of the public permitted in a business or facility that is operating in an outdoor setting at 75 per cent capacity is determined by taking the total square metres of area accessible to the public, dividing that number by 1.33, and rounding the result down to the nearest whole number.

(5) Clause 3.1 (2) (a) of Schedule 1 to the Regulation is amended by adding “or outdoor” after “indoor”.

2. (1) Subsection 1 (5) of Schedule 2 to the Regulation is amended by striking out “23” in the portion before clause (a).

(2) Subsection 2 (6) of Schedule 2 to the Regulation is amended by striking out “22” in the portion before clause (a).

(3) Paragraph 1 of subsection 13 (1) of Schedule 2 to the Regulation is revoked.

(4) Paragraph 1 of section 14 of Schedule 2 to the Regulation is amended by striking out “The space for any” at the beginning and substituting “Any indoor space for”.

(5) Paragraph 2 of section 14 of Schedule 2 to the Regulation is revoked and the following substituted:

2. The total number of students permitted to be in each indoor instructional space at any one time must be limited to the number that can maintain a physical distance of at least two metres from every other person in the space, and in any event, cannot exceed 50 per cent of the capacity of the instructional space as determined in accordance with subsection 3 (3) of Schedule 1, or 1,000 persons, whichever is less.

(6) Section 17 of Schedule 2 to the Regulation is revoked and the following substituted:

Indoor recreational amenities

17. (1)  Indoor recreational amenities may open if they comply with the following conditions:

1. The conditions set out in section 16.

2. The total number of members of the public who are permitted to be in the amenity at any one time must be limited to 50 per cent of the capacity of the amenity, as determined in accordance with subsection 3 (3) of Schedule 1.

3. The person responsible for the recreational amenity, or, where there is no such responsible person, the person holding a permit for the use of the recreational amenity, must post a sign in a conspicuous location visible to the public that states the capacity limits under which the recreational amenity is permitted to operate.

(2) Paragraphs 2 and 3 of subsection (1) do not apply in a location in respect of which an election has been made under section 2.2 of Schedule 1 during the period when the election is in effect.

(7) Paragraph 6 of subsection 22 (1) of Schedule 2 to the Regulation is amended by striking out “seated”.

(8) Section 23 of Schedule 2 to the Regulation is revoked.

(9) Paragraph 1 of subsection 24 (1) of Schedule 2 to the Regulation is revoked.

(10) Paragraphs 3 and 4 of subsection 24 (1) of Schedule 2 to the Regulation are revoked and the following substituted:

3. The number of members of the public at an indoor seated event or activity within the attraction at any one time must not exceed 50 per cent of the usual seating capacity for the event or activity, as determined in accordance with subsection 3 (3) of Schedule 1, or 1,000 persons, whichever is less.

(11) Paragraph 5 of subsection 24 (1) of Schedule 2 to the Regulation is amended by striking out “subparagraph 3 i” and substituting “paragraph 3”.

(12) Subsection 24 (1.1) of Schedule 2 to the Regulation is amended by striking out “1 to 5” and substituting “2, 3, 5”.

(13) Paragraphs 1 and 3 of subsection 27 (1) of Schedule 2 to the Regulation are revoked.

(14) Subsection 27 (1.1) of Schedule 2 to the Regulation is amended by striking out “1 to 4” and substituting “2, 4”.

(15) Paragraphs 1 and 3 of subsection 28 (1) of Schedule 2 to the Regulation are revoked.

(16) Subsection 28 (1.1) of Schedule 2 to the Regulation is amended by striking out “1 to 4” and substituting “2, 4”.

(17) Paragraph 1 of section 29 of Schedule 2 to the Regulation is amended by adding “while on an indoor portion of the tour” at the end.

(18) Paragraph 1 of section 30 of Schedule 2 to the Regulation is amended by adding “while in an indoor part of the vessel” after “on the vessel”.

3. (1) Subclause 1 (1) (a) of Schedule 3 to the Regulation is revoked and the following substituted:

(a) an organized public event of more than 25 people if the event is held indoors;

(2) Section 4 of Schedule 3 to the Regulation is amended by adding “or” at the end of clause (a), by striking out “or” at the end of clause (b) and by revoking clause (c).

(3) Subsection 7 (5) of Schedule 3 to the Regulation is revoked and the following substituted:

(5) During the period when an election described in subsection (1) is in effect, the person responsible for the location in which the wedding, funeral or religious service, rite or ceremony takes place shall post signs at all entrances to the room, in a conspicuous location visible to the public, that inform persons that proof of vaccination is required in order to enter the room.

4. The Regulation is amended by striking out “subsection 3 (2) of Schedule 1” wherever it appears and substituting in each case “section 3.0.1 of Schedule 1”.

Commencement

5. This Regulation comes into force on the day it is filed.
