Amending O. Reg. 258/98
(RULES OF THE SMALL CLAIMS COURT)
1. (1) Subrule 20.06 (2) of Ontario Regulation 258/98 is revoked and the following substituted:
Duration of Writ
(2) A writ of seizure and sale of personal property expires on the sixth anniversary of the date of its issue or, if it is renewed under subrule (3), on the sixth anniversary of the date on which it would have expired had it not been renewed.
(2) Subrule 20.06 (3) of the Regulation is amended by adding “that is filed with the bailiff” after “A writ of seizure and sale of personal property”.
(3) Rule 20.06 of the Regulation is amended by adding the following subrule:
Limitation
(3.1) A request to renew under subrule (3) may only be filed during the six year period preceding the expiration to which the request relates.
2. (1) Rule 20.07 of the Regulation is amended by adding the following subrule:
Writ of Seizure and Sale of Land
(0.1) In this rule,
“authorized Teranet user” means,
(a) a lawyer or paralegal, or
(b) a Minister or body acting under the authority of an Act of Canada or Ontario; (“utilisateur autorisé de Teranet”)
“Teranet software” means the software developed by Teranet Inc. that is authorized by the Ministry of the Attorney General for the purposes of this rule. (“logiciel de Teranet”)
(2) Subrules 20.07 (1.3) to (1.5) of the Regulation are revoked and the following substituted:
Issuance Through Teranet Software
(1.3) An authorized Teranet user may use the Teranet software to have the writ of seizure and sale of land issued, without filing an affidavit for enforcement request under subrule (1).
(1.4) A writ of seizure and sale of land issued electronically through the Teranet software does not need to be signed by the clerk or sealed with an electronic version of the seal of the court.
(1.5) Subrule 1.05.1 (6) does not apply to a writ of seizure and sale of land issued electronically through the Teranet software.
(3) Subrule 20.07 (3) of the Regulation is revoked and the following substituted:

(3) A writ of seizure and sale of land expires on the sixth anniversary of the date of its issue or, if it is renewed under subrule (4), on the sixth anniversary of the date on which it would have expired had it not been renewed.
(4) Subrule 20.07 (4) of the Regulation is amended by adding “that is filed with the sheriff” after “a writ of seizure and sale of land”.
(5) Rule 20.07 of the Regulation is amended by adding the following subrule:
Limitation
(5) A request to renew under subrule (4) may only be filed during the six year period preceding the expiration to which the request relates.
3. The rows for Forms 20C, 20D and 20N in the Table of Forms to the Regulation are amended by striking out the date in the column titled “Date of Form” and substituting in each case “May 1, 2025”.
Commencement
4. This Regulation comes into force on the later of October 6, 2025 and the day this Regulation is filed.
