Amending Reg. 194 of R.R.O. 1990
(RULES OF CIVIL PROCEDURE)
1. Rule 4.05 of Regulation 194 of the Revised Regulations of Ontario, 1990 is amended by adding the following subrules:
Conversion from Paper Format
(11) In the case of a proceeding that is commenced or continued in the City of Toronto, the registrar may prepare an electronic copy of any document that was filed or issued in the proceeding in paper format and include it in the court file.
(12) If the registrar prepares an electronic copy of a paper document, the registrar may return the paper document to the person who filed it or to whom it was issued, in which case subrule (10) applies with necessary modifications to the returned document.
(13) Subrules (11) and (12) apply with necessary modifications with respect to documents filed with the sheriff in the City of Toronto, in which case a reference in those subrules to the registrar shall be read as a reference to the sheriff.
(14) An electronic copy of a filed or issued document that is prepared under subrule (11) shall be considered to be the document as it was filed or issued in the proceeding.
2. Rule 4.05.1 of the Regulation is amended by adding the following subrule:
Non-Application, City of Toronto
(1.1) This rule does not apply with respect to proceedings commenced or continued in the City of Toronto.
3. Rule 4.05.2 of the Regulation is amended by adding the following subrule:
Non-Application, City of Toronto
(1.1) This rule does not apply with respect to proceedings commenced or continued in the City of Toronto.
4. The Regulation is amended by adding the following rule:
Ontario Courts Public Portal
4.05.2.1 (1) In this rule,
“Ontario Courts Public Portal” means the software authorized by the Ministry of the Attorney General for the purposes of this rule and that is available on the internet under the name “Ontario Courts Public Portal” in English and “Portail public des tribunaux de l’Ontario” in French.

(2) This rule applies with respect to,
(a) the filing and issuance of documents in proceedings commenced or continued in the City of Toronto; and
(b) the filing of documents with the sheriff in the City of Toronto.
Permitted Use
(3) Any document that, under these rules, may or must be filed with the registrar or sheriff or issued may be submitted for filing or issuance electronically through the Ontario Courts Public Portal if,
(a) the Portal provides for the electronic filing or issuance of the document; and
(b) the person requesting the filing or issuance of the document has agreed to the Portal’s terms of use and submitted, through the Portal, an e-mail address at which the person agrees to accept documents electronically.
Subject to Confirmation
(4) A document submitted for filing or issuance through the Ontario Courts Public Portal is considered to have been filed or issued only if the registrar or sheriff sends confirmation of the filing or issuance by e-mail.
Filing or Issuance Date
(5) A document submitted for filing or issuance through the Ontario Courts Public Portal is considered to have been filed or issued on the filing or issuance date indicated in the confirmation.
Inconsistencies
(6) In the event of an inconsistency between information provided in a document submitted and accepted for filing or issuance electronically through the Ontario Courts Public Portal and information provided through the Portal by the person submitting the document,
(a) the information in the document as accepted for filing or issuance prevails, except with respect to the county specified by the person for the purposes of Rule 13.1, if applicable, where the information provided through the Portal prevails; and
(b) the registrar or sheriff may request from the person written clarification, in the manner specified by the registrar or sheriff, respecting the inconsistency, and the person shall promptly provide it.
Non-Application of Certain Subrules
(7) Subrules 4.05 (4.2), (7) and (8) do not apply with respect to a document filed or issued electronically by using the Ontario Courts Public Portal.
5. (1) Rule 4.05.3 of the Regulation is amended by adding the following subrule:
Modification, City of Toronto
(3.0.1) In the case of a proceeding that is commenced or continued in the City of Toronto, the documents referred to in paragraphs 1 and 2 of subrule (3) in respect of each party shall be uploaded to Case Center by the registrar and not by the party.
(2) Subrule 4.05.3 (4) of the Regulation is amended by striking out “subrule (5)” in the portion before paragraph 1 and substituting “subrules (4.1) and (5)”.
(3) Rule 4.05.3 of the Regulation is amended by adding the following subrule:
(4.1) Subrule (4) does not apply to the registrar.
(4) Subrule 4.05.3 (8) of the Regulation is amended by striking out “The party shall ensure that every document that the party uploads to Case Center” at the beginning and substituting “A party who uploads a document to Case Center or the registrar, as the case may be, shall ensure that the document”.
(5) Subrule 4.05.3 (9) of the Regulation is amended by striking out the portion before clause (a) and substituting the following:
Requirement to Keep Original
(9) If a party uploads a document to Case Center that is not in the court file, the party shall,
. . . . .
6. Subrule 14.03 (4.1) of the Regulation is amended by striking out “the Civil Claims Online Portal under rule 4.05.1 or the Civil Submissions Online Portal under rule 4.05.2” at the end and substituting “the Civil Claims Online Portal under rule 4.05.1, the Civil Submissions Online Portal under rule 4.05.2 or the Ontario Courts Public Portal under rule 4.05.2.1”.
7. Subrule 14.05 (1.1) of the Regulation is amended by adding “or the Ontario Courts Public Portal under rule 4.05.2.1” at the end.
Commencement
8. (1) Except as otherwise provided in this section, this Regulation comes into force on the later of October 4, 2025 and the day this Regulation is filed.
(2) Sections 4 to 7 come into force on the later of October 14, 2025 and the day this Regulation is filed.
