Amending O. Reg. 865/93

(REGISTRATION)

1. Subsection 10 (3) of Ontario Regulation 865/93 is amended by adding “Subject to subsection 10.1 (1)” at the beginning.

2. The Regulation is amended by adding the following section:

PROVISIONAL CERTIFICATE

10.1 (1) Subject to subsection (2), a certificate of registration of any class issued by order of the Registration Committee is deemed to be a provisional certificate of registration under the Act if the following criteria are satisfied:

1.  The order of the Registration Committee,

i.  directs the Registrar to impose terms, conditions or limitations on the certificate of registration, or

ii.  indicates the certificate of registration is subject to terms, conditions or limitations imposed pursuant to subparagraph 2 i of subsection 22.18 (7) of the Health Professions Procedural Code.

2.  Other than the terms, conditions or limitations mentioned in paragraph 1, no other terms, conditions or limitations are imposed on the certificate of registration by any committee including the Registration Committee.

(2) A certificate of registration is not deemed to be a provisional certificate of registration under subsection (1) if the Registration Committee has imposed terms, conditions or limitations on the certificate of registration resulting from a referral to the Registration Committee pursuant to clause 15 (2) (a) of the Health Professions Procedural Code and subsection 2 (1) of this Regulation.

(3) A holder of a provisional certificate of registration may practise medicine only in accordance with the terms, conditions and limitations of the certificate. 

(4) A holder of a provisional certificate of registration who applies for an independent practice certificate is exempt from the standards and qualifications required under paragraphs 2, 3 and 4 of subsection 3 (1) if the member satisfies the following standards and qualifications:

1.  The member has held one of the following continuously during the five-year period immediately preceding the application:

i.  A restricted certificate of registration that was deemed to be a provisional certificate of registration under subsection (1).

ii.  A provisional certificate of registration.

2.  During the five-year period immediately preceding the application,

i.  no terms, conditions or limitations were imposed on the certificate of registration by any committee, including the Registration Committee, other than the term, condition and limitation imposed by order of the Registration Committee authorizing the member to practice independently limited to a specified scope of practice, and

ii.   the member has practised continuously in Ontario.

3. The Regulation is amended by adding the following section:

RETIRED CLASS

13.1 (1) The standards and qualifications for a certificate of registration in the retired class are as follows:

1.  The applicant is a member who holds one of the following:

i.  A certificate of registration authorizing independent practice.

ii.  A provisional certificate of registration, subject to the terms, conditions and limitations imposed by order of the Registration Committee authorizing the member to practice independently limited to a specified scope of practice, and no other terms.

2.  The applicant is not engaged in active practice in any jurisdiction.

3.  The applicant is not in default of any obligation to the College, including, but not limited to, the payment of any outstanding fees, penalties or any other amount owing to the College.

(2) The following are terms, conditions and limitations of a certificate of registration in the retired class:

1.  The member shall not engage in the practice of medicine or provide any health care services.

(3) A member in the retired class is exempt from section 29 of Ontario Regulation 114/94 (General) made under the Medicine Act, 1991.

(4) A member who holds a certificate of registration in the retired class for less than two years may, upon application for reinstatement, be issued a certificate of registration of the class they held on the day prior to the issuance of their certificate of registration in the retired class, if the member fulfils all of the following requirements:

1.  The member submits a completed application in the form provided by the College.

2.  The member pays the applicable fee.

3.  The member is not in default of any obligation to the College, including, but not limited to, the payment of any outstanding fees, penalties or any other amount owing to the College.

4.  The member meets the non-exemptible standards and qualifications set out in subsection 2 (1).

5.  The member meets the registration requirements in clauses 2 (2) (b), (d) and (e).

6.  The member has engaged in the practice of medicine in Ontario within two years prior to the date of the application for reinstatement under this section.

(5) For the purposes of paragraph 4 of subsection (4), but without limiting its application, if any of the following circumstances apply, the member is deemed to not meet the non-exemptible standards and qualifications set out in subsection 2 (1): 

1.  The member is the subject of allegations of professional misconduct, incompetence or incapacity.

2.  The member is under investigation by the College or any body that regulates a profession inside or outside Ontario.

3.  The member is subject to an order of any committee of the College.

(6) For greater certainty, nothing in subsection (4) prevents a member who holds a certificate of registration in the retired class from applying for a new certificate of registration under the Health Professions Procedural Code.

Commencement

4. (1) Except as otherwise provided in this section, this Regulation comes into force on the later of January 1, 2026 and the day this Regulation is filed.

(2) Section 3 comes into force on the later of April 1, 2026 and the day this Regulation is filed.
