Amending Reg. 543 of R.R.O. 1990
(X-RAY SAFETY CODE)
1. (1) Section 1 of Regulation 543 of the Revised Regulations of Ontario, 1990 is amended by adding the following definitions:
“dentist” means a member of the Royal College of Dental Surgeons of Ontario; (“dentiste”)
“medical radiation and imaging technologist” means a member of the College of Medical Radiation and Imaging Technologists of Ontario; (“technologue en radiation médicale et en imagerie médicale”)
“oral and maxillofacial radiologist” means a member of the Royal College of Dental Surgeons of Ontario who holds a specialty certificate of registration authorizing the practice of the specialty of oral and maxillofacial radiology; (“radiologiste buccal et maxillo-facial”)
“oral and maxillofacial surgeon” means a member of the Royal College of Dental Surgeons of Ontario who holds a specialty certificate of registration authorizing the practice of the specialty of oral and maxillofacial surgery; (“chirurgien buccal et maxillo-facial”)
“out of province dental hygienist” means a person who is exempted from subsections 9 (1) and (2) of the Dental Hygiene Act, 1991 by a regulation made under that Act; (“hygiéniste dentaire hors province”)
“out of province dentist” means a person who is exempted from subsections 9 (1) and (2) of the Dentistry Act, 1991 by a regulation made under that Act; (“dentiste hors province”)
“out of province medical radiation and imaging technologist” means a person who is exempted from subsections 9 (1) and (2) of the Medical Radiation and Imaging Technology Act, 2017 by a regulation made under that Act; (“technologue en radiation médicale et en imagerie médicale hors province”)
“out of province oral and maxillofacial radiologist” means a person who is exempted from subsections 9 (1) and (2) of the Dentistry Act, 1991 by a regulation made under that Act and who holds the equivalent of a certificate of registration in the specialty class of dentistry which authorizes the practice of oral and maxillofacial radiology in Ontario; (“radiologiste buccal et maxillo-facial hors province”)
“out of province oral and maxillofacial surgeon” means a person who is exempted from subsections 9 (1) and (2) of the Dentistry Act, 1991 by a regulation made under that Act and who holds the equivalent of a certificate of registration in the specialty class of dentistry which authorizes the practice of oral and maxillofacial surgery in Ontario; (“chirurgien buccal et maxillo-facial hors province”)
(2) The definitions of “out of province medical practitioner” and “out of province registered nurse in the extended class” in section 1 of the Regulation are revoked and the following substituted:
“out of province medical practitioner” means a person who is exempted from subsections 9 (1) and (3) of the Medicine Act, 1991 by a regulation made under that Act and who holds the equivalent of a certificate of registration authorizing independent practice in Ontario; (“médecin hors province”)
“out of province registered nurse in the extended class” means a person who is exempted from subsections 11 (1) and (5) of the Nursing Act, 1991 by a regulation made under that Act and who holds the equivalent of a certificate of registration in the extended class for registered nurses in Ontario; (“infirmière autorisée ou infirmier autorisé de la catégorie supérieure hors province”)
2. Subsection 5 (2) of the Regulation is amended by striking out “a member of the College of Medical Radiation and Imaging Technologists of Ontario” and substituting “a medical radiation and imaging technologist or an out of province medical radiation and imaging technologist”.
3. (1) Paragraphs 1 and 2 of subsection 5.2 (1) of the Regulation are revoked and following substituted:
1. A legally qualified medical practitioner or an out of province medical practitioner.
2. A medical radiation and imaging technologist or an out of province medical radiation and imaging technologist.
(2) Clause 5.2 (2) (b) of the Regulation is revoked and the following substituted:
(b) an oral and maxillofacial surgeon or an out of province oral and maxillofacial surgeon; or
4. (1) Paragraphs 1 to 3 of subsection 5.3 (1) of the Regulation are revoked and the following substituted:
1. An oral and maxillofacial radiologist or an out of province oral and maxillofacial radiologist.
2. A dentist in compliance with the standards of practice set out in the document dated April 18, 2011 and entitled “Standard of Practice – Dental CT Scanners” that is published by the Royal College of Dental Surgeons of Ontario and approved by the Council of that College.
3. A medical radiation and imaging technologist or an out of province medical radiation and imaging technologist who is under the supervision of a person described in paragraph 1 or 2.
(2) Clause 5.3 (2) (a) of the Regulation is amended by striking out “by a dentist” at the end and substituting “by a dentist or an out of province dentist”.
5. The Regulation is amended by adding the following section:
5.4 A member of the following classes of persons is exempt from the prohibition in subsection 5 (1) of the Act:
1. An out of province medical practitioner.
2. An out of province dentist.
3. An out of province medical radiation and imaging technologist.
4. An out of province dental hygienist.
6. Section 6 of the Regulation is amended by striking out “Members of the College of Medical and Imaging Technologists of Ontario” at the beginning and substituting “Medical radiation and imaging technologists and out of province medical radiation and imaging technologists”.
7. Subsections 6.1 (1) and (2) of the Regulation are revoked and the following substituted:
6.1 An out of province medical practitioner, an out of province registered nurse in the extended class and an out of province dentist are prescribed as persons who can prescribe irradiation for the purposes of clause 6 (1) (h) of the Act.
8. (1) Items 2 to 4 of Table 1 to the Regulation are amended by adding “or out of province Dentist” after “Dentist” wherever it appears in Column 2.
(2) Item 6 of Table 1 to the Regulation is amended by striking out “Medical Radiation and Imaging Technologist” in Column 2 and substituting “Medical Radiation and Imaging Technologist or out of province Medical Radiation and Imaging Technologist”.
Commencement
9. This Regulation comes into force on the later of January 1, 2026 and the day this Regulation is filed.
