Amending O. Reg. 746/21

(LICENSING)

1. The French version of clause 9 (2) (d) of Ontario Regulation 746/21 is amended by adding “en ligne” after “commandées ou achetées”.

2. The French version of clause 14 (2) (b) of the Regulation is amended by striking out “pour lesquels une cotisation a été établie à son égard dans le cadre d’une telle loi pour lesquels les modalités de paiement de ceux-ci n’ont pas été prévues” at the end and substituting “ayant fait l’objet d’une cotisation établie dans le cadre d’une telle loi et pour lesquels des modalités de paiement n’ont pas été prévues”.

3. (1) Subsections 35 (1) and (2) of the Regulation are revoked and the following substituted:

Prohibition on sale, storage, etc.

(1) The licensee may not keep for sale, sell or serve liquor unless the liquor was,

(a) purchased from the LCBO; or

(b) transferred to the licensed premises from another licensed premises in accordance with the conditions set out in subsection (3).

(2) The licensee shall provide their licence number to the LCBO before purchasing any liquor.

(2.1) Despite subsection (1), the licensee may keep for sale, sell or serve liquor purchased from the holder of the Brewers Retail Inc. licence or beer purchased from the holder of a brewery licence if the liquor or beer was purchased before April 1, 2026.

(2) Subsection 35 (3) of the Regulation is amended by striking out “clause (1) (c)” in the portion before paragraph 1 and substituting “clause (1) (b)”.

4. (1) Subsection 52 (1) of the Regulation is amended by striking out “or from the holder of the Brewers Retail Inc. licence” at the end.

(2) Subsection 52 (2) of the Regulation is amended by striking out “seller” and substituting “LCBO”.

(3) Section 52 of the Regulation is amended by adding the following subsection:

(3) Despite subsection (1), the licensee may, under the mini bar licence or mini bar endorsement, keep for sale or sell liquor purchased from the holder of the Brewers Retail Inc. licence before April 1, 2026.

5. Subsection 70.1 (5) of the Regulation is revoked.

6. Paragraph 5 of subsection 74 (1) of the Regulation is revoked.

7. Subsection 88 (2) of the Regulation is revoked and the following substituted:

(2) A licensee that permits customers to order liquor other than in person at the grocery store or convenience store must ensure that any liquor ordered is supplied from the licensee’s inventory that is stored at the grocery store or convenience store.

8. (1) Subsection 89 (2) of the Regulation is amended by striking out “energy drinks and”.

(2) The Table to subsection 89 (7) of the Regulation is amended by adding the following row:

9. (1) The French version of clause 96 (1) (a) of the Regulation is amended by striking out “à l’agent de vente d’une boutique de vins” and substituting “à la boutique de vins”.

(2) Subsection 96 (2) of the Regulation is revoked and the following substituted:

(2) A licensee that permits customers to order wine other than in person at the grocery store must ensure that any wine ordered is supplied from the licensee’s inventory that is stored at the wine boutique.

10. Subsection 100 (1) of the Regulation is revoked and the following substituted:

Conduct of sales, wine boutique endorsement

(1) A licensee that permits customers to order wine other than in person at the grocery store at which the wine boutique is located must ensure that any wine ordered is supplied from the licensee’s inventory that is stored at that wine boutique.

11. (1) The English version of subsection 101 (3) of the Regulation is amended by adding “and” at the end of clause (a).

(2) Clause 101 (3) (b) of the Regulation is revoked and the following substituted:

(b) any other products displayed in the contiguous product display area are products from the grocery store that do not promote the immoderate consumption of liquor and that are displayed by the holder of the wine boutique sales agent endorsement for the purpose of cross-promotion with the wine.

12. Subsection 106 (2) of the Regulation is revoked and the following substituted:

(2) The licensee may sell beer only through its retail stores or to the LCBO.

13. (1) Clause 136 (1) (c) of the Regulation is revoked.

(2) Subsection 136 (2) of the Regulation is amended by striking out “clause (1) (a), (b) or (c)” in the portion before clause (a) and substituting “clause (1) (a) or (b)”.

(3) Subsections 136 (3) and (4) of the Regulation are revoked.

Commencement

14. (1) Except as otherwise provided in this section, this Regulation comes into force on the later of January 1, 2026 and the day this Regulation is filed.

(2) Sections 3, 4, 6, 12 and 13 come into force on the later of April 1, 2026 and the day this Regulation is filed.
