Amending Reg. 194 of R.R.O. 1990

(RULES OF CIVIL PROCEDURE)

1. Subrule 13.1.01 (2) of Regulation 194 of the Revised Regulations of Ontario, 1990 is revoked and the following substituted:

If No Statute or Rule

(2) If subrule (1) does not apply, the proceeding shall be commenced at a court office in a county with which there is a rational connection, as determined on the basis of the factors listed in clause 13.1.02 (2) (b), and that county shall be named in the originating process.

2. (1) Subrules 13.1.02 (4) to (6) of the Regulation are revoked and the following substituted:

Transfer on Court’s Initiative

(4) If subrule (1) does not apply, a judge or associate judge sitting in the county in which the proceeding was commenced may, on their own initiative and subject to subrules (5) and (6), make an order to transfer the proceeding to another county. 

(5) Before making an order under subrule (4), the judge or associate judge shall convene a case conference under rule 50.13 to consider whether the order should be made. 

(6) An order under subrule (4) may be made only if the judge or associate judge is satisfied that the transfer is desirable in the interest of justice, having regard to the factors listed in clause (2) (b).

(2) Subrule 13.1.02 (12) of the Regulation is revoked.

Commencement

3. (1) Except as otherwise provided by this section, this Regulation comes into force on the day it is filed.

(2) Section 1 comes into force on the later of February 1, 2026 and the day this Regulation is filed.
