Amending O. Reg. 73/94

(GENERAL)

1. (1) Subsection 3 (1) of Ontario Regulation 73/94 is amended by adding the following paragraph:

21. Species Conservation Act, 2025.

(2) Subsections 3 (3.0.1) and (3.0.2) of the Regulation are revoked.

2. Section 4 of the Regulation is amended by adding the following subsections:

(3) Despite subsection (1), the following instruments are exempt from sections 19 to 26 of the Environmental Bill of Rights, 1993:

1. A notice or order issued under section 19 of the Species Conservation Act, 2025.

2. A permit issued under section 22 of the Species Conservation Act, 2025.

3. An order issued under section 36, 37, 38 or 39 of the Species Conservation Act, 2025.

(4) Despite subsection (1), any agreement entered into under the Endangered Species Act, 2007 that is continued under the Species Conservation Act, 2025 is exempt from sections 19 to 26 of the Environmental Bill of Rights, 1993.

3. Subsection 6 (1.1.0.1) of the Regulation is amended by striking out “Endangered Species Act, 2007” and substituting “Species Conservation Act, 2025”.

4. Subsection 7 (2.0.1) of the Regulation is revoked.

5. Section 8.1 of the Regulation is revoked.

6. (1) Paragraph 4 of subsection 9 (1) of the Regulation is revoked.

(2) Paragraph 17.1 of subsection 9 (1) of the Regulation is revoked.

(3)  Subsection 9 (1) of the Regulation is amended by adding the following paragraphs:

18. Species Conservation Act, 2025.

19. Toxics Reduction Act, 2009.

7. Section 11.1 of the Regulation is revoked.

8. Subsection 12 (2.0.0.1) of the Regulation is amended by striking out “Endangered Species Act, 2007” and substituting “Species Conservation Act, 2025”.

Commencement

9. This Regulation comes into force on the later of the day section 1 of Schedule 10 (Species Conservation Act, 2025) to the Protect Ontario by Unleashing our Economy Act, 2025 comes into force and the day this Regulation is filed.
