Amending O. Reg. 340/94

(DRIVERS’ LICENCES)

1. (1) The English version of clause 2 (3) (a) of Ontario Regulation 340/94 is amended by striking out “his or her” and substituting “the farmer’s”.

(2) The English version of clause 2 (4) (b) of the Regulation is amended by striking out “his or her” and substituting “the officer’s”.

2. (1) The English version of subsection 5 (1) of the Regulation is amended by striking out “him or her” in the portion before paragraph 1 and substituting “the driver”.

(2) The English version of subsection 5 (2) of the Regulation is amended by striking out “he or she” in the portion before clause (a) and substituting “the person”.

3. The English version of subsection 6 (3) of the Regulation is amended by striking out “he or she” and substituting “they”.

4. Subsection 11 (5) of the Regulation is amended by striking out “Fees paid by a person under subsection 26 (1)” at the beginning and substituting “Fees paid by a person under section 5.0.1 of the Act or subsection 26 (1)”.

5. (1) The English version of subsection 12.1 (1) of the Regulation is amended by striking out “he or she” and substituting “the applicant”.

(2) The English version of subsection 12.1 (2) of the Regulation is amended by striking out “he or she intends” and substituting “they intend”.

(3) The English version of subsection 12.1 (3) of the Regulation is amended by striking out “he or she has” and substituting “they have”.

(4) The English version of subsection 12.1 (4) of the Regulation is amended by striking out “his or her” in the portion before clause (a) and substituting “the”.

6. (1) The English version of paragraph 1 of subsection 13 (1) of the Regulation is amended by striking out “he or she” and substituting “the applicant”.

(2) The English version of section 13 of the Regulation is amended by striking out “his or her” wherever it appears and substituting in each case “their”.

7. (1) The English version of clause 14 (2) (b) of the Regulation is amended by striking out “he or she” and substituting “the applicant”.

(2) The English version of section 14 of the Regulation is amended by striking out “his or her” wherever it appears and substituting in each case “their”.

8. The English version of sections 16 and 16.2 of the Regulation are amended by striking out “he or she” wherever it appears and substituting in each case “the holder”.

9. (1) The French version of clauses 18 (1) a) and b) of the Regulation are revoked and the following substituted:

a) une acuité visuelle, mesurée à l’aide de l’échelle de Snellen, égale ou supérieure à 20/50 lorsque les deux yeux sont ouverts et font simultanément l’objet d’un examen, et ce avec ou sans l’aide de verres correcteurs;

b) un champ de vision horizontal d’au moins 120 degrés continus le long du méridien horizontal et d’au moins 15 degrés continus au-dessus et en dessous du point de fixation, lorsque les deux yeux sont ouverts et font simultanément l’objet d’un examen.

(2) The French version of clauses 18 (2) a) and b) of the Regulation are revoked and the following substituted:

a) une acuité visuelle, mesurée à l’aide de l’échelle de Snellen, égale ou supérieure à 20/50 lorsque les deux yeux sont ouverts et font simultanément l’objet d’un examen, et ce avec ou sans l’aide de verres correcteurs et avec ou sans l’aide de verres télescopiques;

b) un champ de vision horizontal d’au moins 120 degrés continus le long du méridien horizontal et d’au moins 15 degrés continus au-dessus et en dessous du point de fixation, lorsque les deux yeux sont ouverts et font simultanément l’objet d’un examen.

(3) The French version of clauses 18 (3) a) and b) of the Regulation are revoked and the following substituted:

a) une acuité visuelle, mesurée à l'aide de l'échelle de Snellen, égale ou supérieure à 20/30 lorsque les deux yeux sont ouverts et font simultanément l'objet d'un examen, l'œil le plus faible ayant une acuité visuelle égale ou supérieure à 20/100, et ce avec ou sans l'aide de verres correcteurs;

b) un champ de vision horizontal d'au moins 150 degrés continus le long du méridien horizontal et d'au moins 20 degrés continus au-dessus et en dessous du point de fixation, lorsque les deux yeux sont ouverts et font simultanément l'objet d'un examen.

10. (1) The English version of section 20 of the Regulation is amended by striking out “his or her” in the portion before clause (a) and substituting “their”.

(2) The English version of clause 20 (a) of the Regulation is amended by striking out “he or she” and substituting “the holder”.

11. (1) The English version of section 21.1 of the Regulation is amended by striking out “his or her” in the portion before clause (a) and substituting “their”.

(2) The English version of clause 21.1 (c) of the Regulation is amended by striking out “he or she” and substituting “the holder”.

12. (1) The English version of clause 21.2 (1) (a) of the Regulation is amended by striking out “provides evidence that he or she has successfully completed the tests” and substituting “provides evidence of successful completion of the tests”.

(2) The English version of subclause 21.2 (1) (b) (vi) of the Regulation is amended by striking out “he or she” and substituting “the applicant or holder”.

(3) The English version of subsection 21.2 (2.2) of the Regulation is amended by striking out “he or she” and substituting “the holder”.

(4) The English version of section 21.2 of the Regulation are amended by striking out “his or her” wherever it appears and substituting in each case “their”.

13. (1) The English version of clause 21.3 (1) (a) of the Regulation is amended by striking out “provides evidence that he or she has successfully completed the tests” and substituting “provides evidence of successful completion of the tests”.

(2) The English version of subclause 21.3 (1) (b) (x) of the Regulation is amended by striking out “he or she” and substituting “the applicant or holder”.

(3) The English version of section 21.3 of the Regulation are amended by striking out “his or her” wherever it appears and substituting in each case “their”.

14. (1) The English version of clause 22 (a) of the Regulation is amended by striking out “his or her” and substituting “the officer’s”.

(2) The English version of clause 22 (a.1) of the Regulation is amended by striking out “his or her” and substituting “the firefighter’s”.

15. The English version of subsection 23 (1) of the Regulation is amended by striking out “him or her”.

16. The English version of subsection 24 (1) of the Regulation is amended by striking out “him or her” and substituting “the applicant”.

17. (1) Paragraphs 1, 3, 4, 6, 6.1 and 12 of subsection 26 (1) of the Regulation are revoked.

(2) Subsection 26 (1.0.2) of the Regulation is amended by striking out “The fee for a test under paragraph 1, 2, 3, 4 or 5 of subsection (1)” at the beginning and substituting “The fee for a test under section 5.0.1 of the Act or paragraph 2 or 5 of subsection (1)”.

(3) Subsection 26 (2) of the Regulation is amended by striking out “Despite subsection (1)” at the beginning of the portion before paragraph 1 and substituting “Despite section 5.0.1 of the Act and subsection (1)”.

(4) The English version of paragraph 2 of subsection 26 (2) of the Regulation is amended by striking out “his or her” and substituting “their”.

(5) Subsection 26 (3) of the Regulation is amended by striking out “is the fee set out in paragraph 1 or 2 of subsection (1)” and substituting “is the fee set out in paragraph 2 of section 5.0.1 of the Act or paragraph 2 of subsection (1)”.

(6) Subsection 26 (4) of the Regulation is amended by striking out “in any of paragraphs 1 to 5 of subsection (1)” in the portion before paragraph 1 and substituting “in paragraph 2, 3 or 4 of section 5.0.1 of the Act or paragraph 2 or 5 of subsection (1)”.

(7) Paragraphs 1 to 3 of subsection 26 (4) of the Regulation are amended by striking out “subsection (1)” wherever it appears and substituting in each case “section 5.0.1 of the Act or subsection (1)”.

(8) Subsection 26 (5) of the Regulation is amended by striking out “Subsection (1) does not apply” at the beginning of the portion before clause (a) and substituting “Section 5.0.1 of the Act and subsection (1) do not apply”.

18. Section 26.1 of the Regulation is revoked.

19. The English version of clause 27 (1) (b) of the Regulation is amended by striking out “him or her” and substituting “them”.

20. (1) The English version of subsection 28 (7.1) of the Regulation is amended by striking out “his or her” and substituting “a”.

(2) Subsection 28 (10.1) of the Regulation is revoked.

21. (1) Subsections 29 (9) to (13) of the Regulation are revoked and the following substituted:

(9) An applicant for a Class G1, G2 or G driver’s licence who provides evidence satisfactory to the Minister that they are from a jurisdiction other than Ontario or other than a jurisdiction referred to in clause (1) (b) or (2) (b), and who provides evidence satisfactory to the Minister of the period of time during which they held a valid driver’s licence issued by that jurisdiction, shall be credited with that period of time, to a maximum of 12 months, for the purposes of,

(a) determining the length of time during which the applicant is classified as a novice driver in Class G1; and

(b) the prescribed time limits for eligibility to take the level 1 exit test.

(10) An applicant for a Class M1, M2 or M driver’s licence who has not held a driver’s licence in the applicable class for at least 24 months in the preceding three‑year period, and who provides evidence satisfactory to the Minister that they are from a jurisdiction other than Ontario or other than a jurisdiction referred to in clause (1) (b) or (2) (b), and who provides evidence satisfactory to the Minister of the period of time during which they held a valid driver’s licence issued by that jurisdiction, is credited with the period during which the applicant held a valid driver’s licence within the preceding three-year period for the purposes of,

(a) determining the length of time the applicant is classified as a novice driver in Class M1 or M2; and

(b) the prescribed time limits for eligibility to take the level 1 and level 2 exit tests.

(11) An applicant for a Class M driver’s licence may take the applicable level 2 exit test without being subject to the prescribed time limits if the applicant provides evidence satisfactory to the Minister that the applicant is from a jurisdiction other than Ontario or other than a jurisdiction referred to in clause (1) (b) or (2) (b) and has held a driver’s licence in the equivalent licence class for at least 24 months in the preceding three-year period. 

(12) An applicant referred to in subsection (11) who does not complete the level 2 exit test successfully on the first attempt must take and successfully complete the level 1 and 2 exit tests but is exempt from the prescribed time limits on eligibility to take the tests.

(2) The English version of section 29 of the Regulation is amended by striking out “he or she” wherever it appears and substituting in each case “the driver”.

22. The English version of subsection 30 (2) of the Regulation is amended by striking out “on the day he or she schedules the test, he or she holds” and substituting “on the day the holder schedules the test, they hold”.

23. The English version of section 33 of the Regulation is amended by striking out “his or her” wherever it appears and substituting “their”.

24. The French version of the Regulation is amended by,

(a) striking out “les objectifs” wherever it appears and substituting in each case “ les verres”; and

(b) striking out “d’objectifs” wherever it appears and substituting in each case “de verres”.

Commencement

25. (1) Except as provided in this section, this Regulation comes into force on the day it is filed.

(2) Subsections 17 (1) to (3) and (5) to (8) and section 18 come into force on the later of the day section 2 of Schedule 4 to the Reducing Gridlock, Saving You Time Act, 2024 comes into force and the day this Regulation is filed.

(3) Subsection 21 (1) comes into force on the later of July 1, 2026 and the day this Regulation is filed.
