Amending O. Reg. 245/21

(CODE OF ETHICS AND DISCIPLINE AND APPEALS COMMITTEES)

1. Ontario Regulation 245/21 is amended by adding the following section:

Refund

20.1 (1) A licensee shall refund all money paid by a purchaser or an owner of land, including deposits, in such circumstances and within such timelines as required by an agreement or otherwise by law.

(2) A licensee shall pay interest on a refund referred to in subsection (1) in such circumstances, within such timelines and in such an amount as required by an agreement or otherwise by law.

(3) For the purposes of this section, an agreement includes any of the following:

1. A purchase agreement, including an addendum completed under Ontario Regulation 289//26 (Addenda and Information Sheets for Purchase Agreements) made under the Act.

2. A construction contract.

3. Any other agreement between a vendor and a purchaser.

4. Any other agreement between a builder and an owner of land.

Commencement

2. This Regulation comes into force on the later of the day section 4 of Schedule 1 to the Homeowner Protection Act, 2024 comes into force and the day this Regulation is filed.
