Amending O. Reg. 63/16

(REGISTRATIONS UNDER PART II.2 OF THE ACT - WATER TAKING)

1. (1) Subsection 2 (1) of Ontario Regulation 63/16 is amended by striking out “Subject to subsections (3) and (4)” at the beginning and substituting “Subject to subsections (3) to (5)”.

(2) Section 2 of the Regulation is amended by adding the following subsection:

(5) Subsection (1) does not apply in respect of the taking of water if,

(a) a permit to take water was issued for the water taking under the Ontario Water Resources Act;

(b) the permit was in effect on March 29, 2016; and

(c) the permit has not expired or been revoked.

2. (1) Section 7 of the Regulation is amended by adding the following subsection:

(5.1) Subsection (1) does not apply in respect of the taking of ground water or the taking of storm water if,

(a) a permit to take water was issued for the water taking under the Ontario Water Resources Act;

(b) the permit was in effect on March 29, 2016; and

(c) the permit has not expired or been revoked.

(2) Subsection 7 (6) of the Regulation is amended by striking out “subsection (2) or (5)” at the end and substituting “subsection (2), (5) or (5.1)”.

Commencement

3. This Regulation comes into force on the day it is filed.
