Insurance Contracts — Recovery by Innocent Persons

Prescribed class of persons

1. For the purposes of clause 129.1 (d) of the Act, all classes of persons other than natural persons are prescribed.

Prescribed requirements

2. For the purposes of subsection 129.1 (3) of the Act, the following requirements must be complied with:

1. The person must cooperate with the insurer in the investigation of the loss or damage and must submit to an examination under oath, if requested by the insurer.

2. The person must produce for examination at such reasonable place and time as is designated by the insurer all documents in the person’s possession or control that relate to the loss or damage, in addition to those documents required to be produced under the contract.

Commencement

3. This Regulation comes into force on the later of the day subsection 9 (3) of Schedule 21 to the Stronger, Fairer Ontario Act (Budget Measures), 2017 comes into force and the day it is filed.
