Amending Reg. 611 of R.R.O. 1990

(SAFETY INSPECTIONS)

1. (1) Section 1 of Regulation 611 of the Revised Regulations of Ontario, 1990 is amended by adding the following definitions:

“U10 passenger transportation vehicle”, subject to subsections (2) and (3), means a passenger transportation vehicle that has seating for one to nine passengers; (“véhicule de transport de passagers U10”)

“U10 permit” has the same meaning as in subsection 1 (1) of Regulation 628 of the Revised Regulations of Ontario, 1990 (Vehicle Permits) made under the Act. (“certificat d’immatriculation U10”)

(2) Section 1 of the Regulation is amended by adding the following subsections:

(2) A U10 passenger transportation vehicle does not include a vehicle referred to in section 2, 3, 4 or 5 of Ontario Regulation 418/21 (Passenger Transportation Vehicles) made under the Act.

(3) Despite subsection (2), a U10 passenger transportation vehicle includes any vehicle that has been issued a U10 permit.

2. The Regulation is amended by adding the following section:

4.1.1 If a vehicle is a U10 passenger transportation vehicle that is required to display a semi-annual inspection sticker under section 10, a safety standards certificate shall not be issued in respect of the vehicle unless it has been inspected in accordance with the inspection requirements and complies with the performance standards set out in NSC Standard 11B as modified by sections 1 and 2 of Schedule 3.

3. (1) Section 10 of the Regulation is amended by adding the following subsection:

(4.1) A U10 passenger transportation vehicle is prescribed as a type or class of vehicle to which section 85 of the Act applies.

(2) Subsection 10 (5) of the Regulation is amended by striking out “a school purposes vehicle and an accessible vehicle” and substituting “a school purposes vehicle, an accessible vehicle and a U10 passenger transportation vehicle”.

(3) Subsection 10 (6) of the Regulation is amended by striking out “a school purposes vehicle or an accessible vehicle” in the portion before clause (a) and substituting “a school purposes vehicle, an accessible vehicle or a U10 passenger transportation vehicle”.

(4) Clause 10 (6) (c) of the Regulation is revoked and the following substituted:

(c)  remove or cover any annual or semi-annual inspection sticker relating to a previous inspection and,

(i)  in the case of a bus, school purposes vehicle or accessible vehicle, affix the current semi-annual inspection sticker to the outer surface of the lower right hand corner of the windshield, on a fixed side window as close as practicable to the front of the vehicle or to a conspicuous position on the right side of the vehicle body close to the front of the vehicle, or

(ii)  in the case of a U10 passenger transportation vehicle, affix the current semi-annual inspection sticker to the front lower corner of the front passenger window.

(5) Subsection 10 (10) of the Regulation is revoked and the following substituted:

(10) If a bus, a school purposes vehicle, an accessible vehicle or a U10 passenger transportation vehicle is issued a safety standards certificate in accordance with section 4.1, 4.1.1, 4.2 or 4.4, the licensee of the station in which the vehicle was inspected, a person authorized in writing by the licensee or the motor vehicle inspection mechanic who inspected the vehicle shall at the time of issuing the safety standards certificate also issue a semi-annual inspection certificate and a semi-annual inspection report and affix to the vehicle a semi-annual inspection sticker in the manner described in subsection (6).

4. Subsection 2 (1) of Schedule 3 to the Regulation is amended by striking out “school purposes vehicle or accessible vehicle” and substituting “school purposes vehicle, accessible vehicle or U10 passenger transportation vehicle”.

Commencement

5. This Regulation comes into force on the later of the day subsection 7 (6) of Schedule 23 to the Better for People, Smarter for Business Act, 2020 comes into force and the day this Regulation is filed.
