Amending Reg. 628 of R.R.O. 1990

(VEHICLE PERMITS)

1. (1) Subsections 18 (4.1) and (4.2) of Regulation 628 of the Revised Regulations of Ontario, 1990 are revoked and the following substituted:

(4.1) If a permit described as follows is renewed before March 1, 2022, upon renewal the permit shall be validated until the next anniversary of the original expiry date or the next anniversary after that:

1. The permit’s validity was extended or continued under subsection 2 (3) or (4) of Ontario Regulation 45/20 (Extending Time Periods in Ontario Regulations) made under the Act for a period of more than one year and less than two years.

(4.1.1) The next time a permit described as follows is renewed, upon renewal the permit shall be validated until the next anniversary of the original expiry date or the next anniversary after that:

1. The permit’s validity was extended or continued under subsection 2 (3) or (4) of Ontario Regulation 45/20 (Extending Time Periods in Ontario Regulations) made under the Act or under clause 22.2 (2) (b) of this Regulation.

2. The permit was not renewed before March 1, 2022.

3. The last time the permit was valid due to a validation by the permit holder was at least one year but less than two years before the date of renewal.

(4.1.2) The next time a permit described as follows is renewed, upon renewal the permit shall be validated until the next anniversary of the original expiry date or the next anniversary after that:

1. The permit’s validity was extended or continued under subsection 2 (3) or (4) of Ontario Regulation 45/20 (Extending Time Periods in Ontario Regulations) made under the Act.

2. The permit was not renewed before March 1, 2022.

3. The last time the permit was valid due to a validation by the permit holder was two or more years before the date of renewal.

(4.2) Upon validation of a permit under subsection (4.1), (4.1.1) or (4.1.2), the following fees shall be paid to the Ministry:

1. For a permit that is validated under subsection (4.1) or (4.1.1) until the next anniversary of the original expiry date, twice the applicable annual fee for the appropriate permit number set out in Schedule 4.

2. For a permit that is validated under subsection (4.1) or (4.1.1) until the next anniversary after the anniversary referred to in paragraph 1, three times the applicable annual fee for the appropriate permit number set out in Schedule 4.

3. For a permit that is validated under subsection (4.1.2) until the next anniversary of the original expiry date, three times the applicable annual fee for the appropriate permit number set out in Schedule 4.

4. For a permit that is validated under subsection (4.1.2) until the next anniversary after the anniversary referred to in paragraph 3, four times the applicable annual fee for the appropriate permit number set out in Schedule 4.

(2) Subsection 18 (6.0.1) of the Regulation is revoked and the following substituted:

(6.0.1) Subsections (5) and (6) apply with necessary modifications to a person to whom subsection (4.2) applies.

(3) Subsections 18 (4.1), (4.1.1), (4.1.2), (4.2) and (6.0.1) of the Regulation, as made by subsections (1) and (2), are revoked.

(4) Subsection 18 (7) of the Regulation is amended by striking out the portion before clause (a) and substituting the following:

(7) Subsections (1) and (2) apply, and subsections (4) and (4.2) do not apply, to the renewal of the validation period for,

. . . . .

(5) Subsection 18 (7) of the Regulation, as amended by subsection (4), is amended by striking out the portion before clause (a) and substituting the following:

(7) Subsections (1) and (2) apply, and subsection (4) does not apply, to the renewal of the validation period for,

. . . . .

2. (1) Section 19 of the Regulation is amended by adding the following subsection:

(2.1) Despite subsection (2), for the validation of a permit between September 1, 2021 and December 31, 2023 for a period that is shorter than 12 months, the validation fee is the amount calculated according to the following formula and rounded up to the nearest dollar:

A × (B/12)

in which,

  “A” is the number of months, and

  “B” is the applicable annual fee set out in Schedule 1, 2 or 3.

(2) Subsection 19 (2.1) of the Regulation, as made by subsection (1), is revoked.

3. Sections 19.1 and 19.2 of the Regulation are revoked.

4. (1) The Regulation is amended by adding the following section:

Extensions and Fees

22.2 (1) Despite anything in this Regulation, a vehicle permit referred to in Schedule 1, 2 or 3 is deemed to be valid until December 31, 2021 if,

(a) the term of validity for the permit was extended or continued under Ontario Regulation 45/20 (Extending Time Periods in Ontario Regulations) made under the Act; or

(b) the term of validity for the permit expires on or after September 1, 2021 but before January 1, 2022.

(2) Despite anything in this Regulation, a vehicle permit referred to in Schedule 4 is deemed to be valid until February 28, 2022 if,

(a) the term of validity for the permit was extended or continued under Ontario Regulation 45/20 (Extending Time Periods in Ontario Regulations) made under the Act; or

(b) the term of validity for the permit expires on or after September 1, 2021 but before March 1, 2022.

(3) Despite subsections (1) and (2), the following vehicle permits are deemed to be valid from September 1, 2021 until October 6, 2021:

1. A permit that was last validated by temporary validation under section 5.2 and that expired on or after March 1, 2020 but before October 6, 2021.

2. A special permit that expired on or after March 1, 2020 but before October 6, 2021.

(4) Despite subsections 2 (1) and (8), a safety standards certificate that expired on or after March 1, 2020 but before September 1, 2021 may be validly used from September 1, 2021 until October 6, 2021, whether or not an inspection of the vehicle was completed within 36 days before it is used.

(5) Every owner of a motor vehicle who became a resident of Ontario on or after March 1, 2020 but before September 1, 2021 is exempt from section 7 of the Act from September 1, 2021 until October 6, 2021, provided that the owner has complied with the requirements set out in subsection 15 (2) of the Act.

(6) If a change of name or address described in subsection 9 (2) of the Act or 3.1 of this Regulation or a vehicle modification described in section 3 of this Regulation occurred on or after March 1, 2020 but before February 23, 2022, the person who is required to fulfil the requirement set out in the provision is exempt from the provision from September 1, 2021 until February 28, 2022.

(7) Every owner of a motor vehicle or trailer to whom the six-day period referred to in subsection 11 (2) of the Act applies is exempt from the requirement set out in that subsection for the period from September 1, 2021 until October 6, 2021, if the person became the owner on or after March 1, 2020 but before September 1, 2021.

(8) Despite subsection 11 (4) of the Act, a person is exempt from section 7 and clauses 12 (1) (d) and (e) of the Act from September 1, 2021 until October 6, 2021 if the person complies with all the requirements set out in section 10 of this Regulation, other than the requirement under clause 10 (1) (c) respecting a safety standards certificate.

(9) Subsection (8) does not apply to a person to whom subsection 10 (4) applies.

(2) Section 22.2 of the Regulation, as made by subsection (1), is revoked.

5. (1) The Regulation is amended by adding the following sections:

22.3 (1) This section applies to a motor vehicle permit of a class referred to in section 19, if the permit was extended or continued under subsection 2 (3) or (4) of Ontario Regulation 45/20 (Extending Time Periods in Ontario Regulations) made under the Act or under subsection 22.2 (1) of this Regulation.

(2) When a permit to which this section applies is next renewed, a fee calculated according to the following formula, and rounded up to the nearest dollar, shall be payable in addition to fees payable under section 19:

(A + B) × (C/12)

in which,

  “A” is the number of months determined under subsection (3),

  “B” is the number of months determined under subsection (4), and

  “C” is the annual fee set out in Schedule 1, 2 or 3 that would have applied to that vehicle if the permit had been renewed.

(3) For the purposes of the definition of “A” in subsection (2),

(a) if the permit holder renewed the permit at any time during the period from March 1, 2020 to February 28, 2021, “A” is zero; and

(b) if the permit holder did not renew the permit during the period from March 1, 2020 to February 28, 2021, “A” is the number of months during that period that the extension or continuation described in subsection (1) applies.

(4) For the purposes of the definition of “B” in subsection (2),

(a) if the permit holder renewed the permit at any time during the period from March 1, 2021 to August 31, 2021 and the validation period was deemed under this Regulation to include the period from March 1, 2021 to the date of renewal, “B” is zero;

(b) if the permit holder renewed the permit at any time during the period from September 1, 2021 to December 31, 2021, “B” is the number of months from March 1, 2021 to the date the renewal begins; and

(c) if the permit holder did not renew the permit during the period from March 1, 2021 to December 31, 2021, “B” is the number of months during that period that the extension or continuation described in subsection (1) applies.

(5) No fee is payable under subsection (2) for a calendar month if,

(a) prior to the start of the month, the permit holder surrendered the number plates to the Ministry or applied to the Ministry to remove the number plates from the vehicle; or

(b) the vehicle was not operated during the entire month and the permit holder applies to the Ministry for an exemption for the month,

(i) at the time they apply to enter into an instalment payment plan under subsection (8), or

(ii) if the permit holder does not apply to enter the payment plan, by December 31, 2022.

(6) A permit holder who is granted an exemption under clause (5) (b) shall retain documentation and information demonstrating they satisfied the condition in that clause for a period of two years from the date of renewal and shall provide it upon request of the Ministry.

(7) If a permit holder receives an exemption under clause (5) (b) and fails to comply with subsection (6), or if the Ministry determines that the permit holder provided false or inaccurate documentation or information relating to the exemption, the Ministry may add the fees that were exempted to the validation fee for any permit of the permit holder.

(8) The Ministry may enter into an instalment payment plan with a permit holder to provide for the payment of fees payable under subsection (2).

(9) The fees referred to in subsection (8) are payable,

(a) if the permit holder enters into a payment plan on or before December 31, 2022, on the dates set out in that plan; and

(b) if the permit holder does not enter into a payment plan on or before December 31, 2022, on January 1, 2023.

(10) The payment plan shall require that all such fees be paid no later than December 31, 2023.

22.4 (1) Section 22.3 does not apply to an IRP cab card.

(2) This section applies to an IRP cab card if the validation of the IRP cab card was extended or continued under subsection 2 (3) or (4) of Ontario Regulation 45/20 (Extending Time Periods in Ontario Regulations) made under the Act and the holder of the IRP cab card renews the cab card during the period from September 1, 2021 to December 31, 2021.

(3) The Ministry may enter into an instalment payment plan with the holder of an IRP cab card to provide for the payment of the Ontario portion of IRP cab card fees owing for the time period between March 1, 2020 and December 31, 2021.

(4) The fees referred to in subsection (3) are payable,

(a) if the permit holder enters into a payment plan on or before December 31, 2021, on the dates set out in that plan; and

(b) if the permit holder does not enter into a payment plan on or before December 31, 2021, on January 1, 2022.

(5) The payment plan shall require that all such fees be paid no later than December 31, 2023.

(2) Sections 22.3 and 22.4 of the Regulation, as made by subsection (1), are revoked.

Amendments to O. Reg. 142/21

6. (1) Subsection 1 (3) of Ontario Regulation 142/21 is revoked.

(2) Subsection 2 (2) of the Regulation is revoked.

(3) Subsections 3 (2) and (3) of the Regulation are revoked.

Commencement

7. (1) Subject to subsections (2), (3), (4) and (5) this Regulation comes into force on the day it is filed.

(2) Subsections 1 (1), (2), (4) and 2 (1), section 3 and subsections 4 (1) and 5 (1) come into force on the later of September 1, 2021 and the day it is filed.

(3) Subsection 4 (2) comes into force on March 1, 2022.

(4) Subsections 1 (3) and (5) come into force on April 1, 2023.

(5) Subsections 2 (2) and 5 (2) come into force on January 1, 2024.
