Amending O. Reg. 48/01

(GENERAL)

1. Ontario Regulation 48/01 is amended by adding the following section:

Nuisance, annoyance or disruption

26. For the purposes of clause 117 (2) (b) of the Act, each of the following is prescribed as a nuisance, annoyance or disruption to an individual in a unit, the common elements or the assets, if any, of the corporation if it is unreasonable:

1.  Odour.

2.  Smoke.

3.  Vapour.

4.  Light.

5.  Vibration.

Commencement

2. This Regulation comes into force on the later of the day section 102 of Schedule 1 to the Protecting Condominium Owners Act, 2015 comes into force and the day this Regulation is filed.
