prescribed entities - Subsections 8 (3) and (4) of the Act

Prescribed entities, subs. 8 (3) of the Act

1. The following entities are prescribed for the purposes of paragraph 3 of subsection 8 (3) of the Act:

1. A not-for-profit corporation incorporated or continued under the Not-for-Profit Corporations Act, 2010 or a predecessor of that Act.

2. A not-for-profit corporation incorporated or continued by or under a special Act of the Legislature.

3. A not-for-profit corporation incorporated or continued under the laws of another province or a territory of Canada that is operating or carrying on business in Ontario.

4. A not-for-profit corporation incorporated or continued under the Canada Not-for-profit Corporations Act or a predecessor of that Act that is operating or carrying on business in Ontario.

5. A not-for-profit corporation incorporated or continued under a special Act of the Parliament of Canada that is operating or carrying on business in Ontario.

6. A registered charity as defined in subsection 248 (1) of the Income Tax Act (Canada).

7. An Indigenous governing body that is a council, government or other entity that is authorized to act on behalf of a First Nation, Inuit, Métis or other Indigenous group, community or people that holds rights recognized and affirmed by section 35 of the Constitution Act, 1982.

8. Any entity, other than a governing body mentioned in paragraph 7, that serves the interests of or provides services to First Nation, Inuit, Métis or other Indigenous peoples.

9. A Local Services Board established under Part I of the Northern Services Boards Act.

10. An entity described in any of paragraphs 1 to 9, together with another one or more of those entities.

11. The council of any one municipality, together with one or more of the entities described in paragraphs 1 to 9.

Prescribed entities, subs. 8 (4) of the Act

2. The following entities are prescribed for the purposes of subsection 8 (4) of the Act:

1. An entity described in any of paragraphs 1 to 9 of section 1.

2. An entity described in any of paragraphs 1 to 9 of section 1, together with another one or more of those entities.

Commencement

3. This Regulation comes into force on the later of June 1, 2024 and the day this Regulation is filed.
