Amending O. Reg. 232/18
(INCLUSIONARY ZONING)
1. Paragraphs 5 and 6 of subsection 3 (1) of Ontario Regulation 232/18 are revoked and the following substituted:
5. For the purposes of clause 35.2 (2) (a) of the Act, the number of affordable housing units, or the gross floor area to be occupied by the affordable housing units, that would be required, which, where the development or redevelopment is located within a protected major transit station area identified in accordance with subsection 16 (15) or (16) of the Act, shall not exceed,
i. 5 per cent of the total residential units that are part of the development or redevelopment, or
ii. 5 per cent of the total floor area of all residential units that are part of the development or redevelopment, not including common areas.
6. For the purposes of clause 35.2 (2) (b) of the Act, the period of time for which affordable housing units would be maintained as affordable, which, where the development or redevelopment is located within a protected major transit station area identified in accordance with subsection 16 (15) or (16) of the Act, shall not exceed 25 years.
Commencement
2. This Regulation comes into force on the day it is filed.
