Amending Reg. 194 of R.R.O. 1990

(RULES OF CIVIL PROCEDURE)

1. (1) Subrule 74.18 (11.5) of Regulation 194 of the Revised Regulations of Ontario, 1990 is amended by striking out “and file with proof of service” at the end of the portion before clause (a).

(2) Clause 74.18 (11.7) (b) of the Regulation is amended by adding “together with proof of service” at the end.

2. Subrule 75.03 (3) of the Regulation is revoked and the following substituted:

Notice to Applicant

(3) Where an application for a certificate of appointment of estate trustee has been made and a notice of objection is filed, the registrar shall send notice of the filing (Form 74O or 74.1D) to the applicant or the applicant’s lawyer by,

(a) regular lettermail to the mailing address shown in the application; or

(b) e-mail to the e-mail address most recently indicated for the applicant or the applicant’s lawyer in the applicable court file, if any, or, in the case of a lawyer whose e-mail address is not indicated in the court file, the e-mail address for the lawyer as published on the Law Society of Ontario’s website.

3. (1) The rows for Forms 74A, 74B, 74B.1 and 74J in the Table of Forms to the Regulation are amended by striking out the date in the column titled “Date of Form” and substituting in each case “January 1, 2025”.

(2) The row for Form 74O in the Table of Forms to the Regulation is amended by striking out the date in the column titled “Date of Form” and substituting “January 1, 2025”.

(3) The rows for Forms 74.1A and 74.1B in the Table of Forms to the Regulation are amended by striking out the date in the column titled “Date of Form” and substituting in each case “January 1, 2025”.

(4) The row for Form 74.1D in the Table of Forms to the Regulation is amended by striking out the date in the column titled “Date of Form” and substituting “January 1, 2025”.

(5) The row for Form 75.2 in the Table of Forms to the Regulation is revoked.

Commencement

4. (1) Except as otherwise provided in this section, this Regulation comes into force on the day it is filed.

(2) Sections 1 and 2 and subsections 3 (1), (3) and (5) come into force on the later of August 13, 2025 and the day this Regulation is filed.
