(TRAINING)
1. Section 13 of Ontario Regulation 87/24 is revoked and the following substituted:
Police officer, Niagara Parks constable — carbines
13. (1) This section applies with respect to the following:
1. Every police officer who performs community patrol functions and who may be required to respond to an incident involving an active attacker.
2. Every Niagara Parks constable whose certificate of appointment authorizes them to carry or use a semi-automatic rifle and who has been authorized to carry or use a semi-automatic rifle by the Niagara Parks Commission.
(2) Every police officer and Niagara Parks constable mentioned in subsection (1) shall, in accordance with the following rules, successfully complete the course entitled “Carbine Operator”, delivered by the College or by a certified trainer in respect of the course:
1. In the case of a police officer who was appointed before the transition date, the course shall be completed no later than the second anniversary of the transition date.
2. In the case of a police officer who is appointed as a police officer on or after the transition date or a Niagara parks constable, the course shall be completed within 12 months after subsection (1) begins to apply to the officer or constable, as the case may be.
(3) Every police officer and Niagara Parks constable mentioned in subsection (1) shall, within 12 months after successfully completing the training required under subsection (2) and within every subsequent 12 months, successfully complete the course entitled “Carbine Operator Requalification”, delivered by the College or by a certified trainer in respect of the course.
2. Section 26 of the Regulation is revoked and the following substituted:
Active attacker incidents, initial training
26. (1) Subject to subsection (4), this section applies with respect to the following:
1. Every police officer who performs community patrol functions and who may be required to respond to an incident involving an active attacker.
2. Every Niagara Parks constable whose certificate of appointment authorizes them to carry or use a semi-automatic rifle or a shotgun and who has been authorized to carry or use a semi-automatic rifle or a shotgun by the Niagara Parks Commission.
(2) Every police officer and Niagara Parks constable mentioned in subsection (1) shall successfully complete one of the following:
1. The course entitled “Immediate Rapid Deployment (IRD) Basic”, delivered by the College or by a certified trainer in respect of the course.
2. A course accredited by the Director for the purpose of this provision, delivered by a police service.
(3) The requirement mentioned in subsection (2) shall be complied with no later than 12 months after this section begins to apply to the officer or constable, as the case may be.
(4) This section does not apply to,
(a) a police officer or Niagara Parks constable who successfully completed the program entitled “Basic Constable Training Program”, delivered by the College, after April 30, 2023; or
(b) a police officer who was assigned responsibilities mentioned in paragraph 1 of subsection (1) before the transition date and successfully completed training before that date that the officer’s chief of police has determined is substantially equivalent to one of the courses mentioned in subsection (2).
3. Subsection 27 (2) of the Regulation is revoked and the following substituted:
(2) Subject to subsection (3), in the case of a police officer to whom section 26 does not apply because of clause 26 (4) (a) or (b), the officer shall successfully complete the training required under subsection (1) in accordance with the following rules:
1. In the case of an officer mentioned in clause 26 (4) (a), the training shall be completed by the later of the following days and within every subsequent 24 months after the applicable day:
i. The day that is 24 months after the officer’s successful completion of the training described in clause 26 (4) (a).
ii. The second anniversary of the transition date.
2. In the case of an officer mentioned in clause 26 (4) (b), the training shall be completed no later than the second anniversary of the transition date and within every subsequent 24 months.
4. The Regulation is amended by adding the following section:
Active attacker incidents, ongoing training, Niagara Parks constable
27.1 (1) Subject to subsection (3), a Niagara Parks constable to whom section 26 applies shall, within 24 months after successfully completing the training required under that section and within every subsequent 24 months, successfully complete the training set out in paragraph 1 or 2 of subsection 27 (1).
(2) Subject to subsection (3), in the case of a Niagara Parks constable to whom section 26 does not apply because of clause 26 (4) (a), the constable shall successfully complete the training set out in paragraph 1 or 2 of subsection 27 (1) by the latest of the following days and within every subsequent 24 months after the applicable day:
1. The day that is 24 months after the day the constable successfully completed the training described in clause 26 (4) (a).
2. The day paragraph 2 of subsection 26 (1) begins to apply to the constable.
3. June 1, 2027.
(3) If it is not reasonably possible for the Niagara Parks constable to comply with subsection (1) or paragraph 1 of subsection (2) within a 24-month period, an extension of up to 60 days may be granted by the Niagara Parks Commission during which time the constable shall comply with the requirement.
Commencement
5. This Regulation comes into force on the day it is filed.
