Amending O. Reg. 287/07

(GENERAL)

1. Subsection 1 (2) of Ontario Regulation 287/07 is amended by adding the following definition:

“Ontario Regulation 137/25” means Ontario Regulation 137/25 (Registrations under Part II.2 of the Act – Storm Water Management Works) made under the Environmental Protection Act; (“Règlement de l’Ontario 137/25”)

2. Subsection 23 (3) of the Regulation is amended by striking out “or” at the end of clause (a), by adding “or” at the end of clause (b) and by adding the following clause:

(c)  the activity is prescribed by Ontario Regulation 137/25 for the purposes of subsection 20.21 (1) of the Environmental Protection Act.

3. Clauses 31 (2) (a) and (b) of the Regulation are revoked and the following substituted:

(a)  the activity has not been engaged in in that area and there is no reasonable prospect that the activity will ever be engaged in in that area; or

(b)  the activity is prescribed by Ontario Regulation 137/25 for the purposes of subsection 20.21 (1) of the Environmental Protection Act.

4. The Regulation is amended by adding the following section:

Exemption, monitoring policies

31.1 A source protection plan is not required to include policies mentioned in paragraph 4 of subsection 22 (2) of the Act in respect of an activity that would be a significant drinking water threat in an area identified in the assessment report if the activity is prescribed by Ontario Regulation 137/25 for the purposes of subsection 20.21 (1) of the Environmental Protection Act.

5. (1) Paragraph 6 of subsection 40 (2) of the Regulation is amended by adding “Subject to subsection (2.1)” at the beginning of the portion before subparagraph i.

(2) Section 40 of the Regulation is amended by adding the following subsection:

(2.1) Paragraph 6 of subsection (2) does not apply with respect to an activity mentioned in subsection 31 (2).

6. (1) Paragraphs 8 and 9 of subsection 51 (1) of the Regulation are amended by striking out “to a source protection plan” wherever it appears.

(2) Subsection 51 (1) of the Regulation is amended by adding the following paragraph:

10.  An amendment, other than an amendment that includes the setting out of a policy, that is made to account for,

i.  the making of Ontario Regulation 137/25, or

ii.  amendments made to this Regulation by Ontario Regulation 139/25 made under the Act.

Commencement

7. This Regulation comes into force on the later of September 1, 2025 and the day this Regulation is filed.
