Amending Reg. 4 of R.R.O. 1990

(FEES AND EXPENSES OF JURORS AND CROWN WITNESSES)

1. (1) Section 1 of Regulation 4 of the Revised Regulations of Ontario, 1990 is amended by adding the following subsection:

(2) Subsection (1) applies to persons selected for jury duty before October 1, 2025.

(2) Section 1 of the Regulation is revoked.

2. (1) The Regulation is amended by adding the following section:

1.1 (1) Subject to subsection (2), a person who is selected on or after October 1, 2025 to be a member of a jury in the Superior Court of Justice shall be paid a fee of $120 for each day they are required to attend as a member of a jury.

(2) A juror shall not receive the fee referred to in subsection (1) on days when they receive income from their employer.

(3) A court shall not change the amount of the fee set out under subsection (1).

(2) Subsection 1.1 (1) of the Regulation, as made by subsection (1), is amended by striking out “on or after October 1, 2025”.

3. (1) Subsection 4 (1) of the Regulation is amended by adding “before October 1, 2025” after “A person summoned” at the beginning.

(2) Subsection 4 (1) of the Regulation is revoked.

(3) Subsection 4 (2) of the Regulation is amended by adding “before October 1, 2025” after “A person who is selected”.

(4) Subsection 4 (2) of the Regulation is revoked.

(5) Section 4 of the Regulation is amended by adding the following subsection:

(2.1) A person who, on or after October 1, 2025, is summoned to attend as a member of a jury panel or selected to be a member of a jury shall only be paid a travel allowance if the person’s usual place of residence is more than 40 kilometres from the court to which the person has been summoned or to the place where the trial is held, as the case may be.

(6) Subsection 4 (2.1) of the Regulation, as made by subsection (5), is amended by striking out “on or after October 1, 2025”.

4. Section 7 of the Regulation is amended by striking out “subsections 3 (1) and 4 (2)” and substituting “subsection 3 (1)”.

Commencement

5. (1) Except as otherwise provided in this section, this Regulation comes into force on the later of October 1, 2025 and the day this Regulation is filed.

(2) Subsections 1 (2), 2 (2) and 3 (2), (4) and (6) and section 4 come into force on the later of October 1, 2026 and the day this Regulation is filed.
