Amending O. Reg. 45/22
(GENERAL)
1. (1) Section 1 of Ontario Regulation 45/22 is amended by adding the following definitions:
“out of province dentist” means a person who is exempted from subsections 9 (1) and (2) of the Dentistry Act, 1991 by a regulation made under that Act; (“dentiste hors province”)
“out of province dietitian” means a person who is exempted from subsections 7 (1) and (2) of the Dietetics Act, 1991 by a regulation made under that Act; (“diététiste hors province”)
“out of province midwife” means a person who is exempted from subsections 8 (1) and (2) of the Midwifery Act, 1991 by a regulation made under that Act; (“sage-femme hors province”)
“out of province pharmacist” means a person who is exempted from subsections 10 (1) and (2) of the Pharmacy Act, 1991 by a regulation made under that Act and who holds the equivalent of a certificate of registration in the pharmacist class in Ontario; (“pharmacien hors province”)
“out of province pharmacy technician” means a person who is exempted from subsections 10 (1) and (2) of the Pharmacy Act, 1991 by a regulation made under that Act and who holds the equivalent of a certificate of registration in the pharmacy technician class in Ontario; (“technicien en pharmacie hors province”)
(2) The definitions of “health professional”, “out of province physician”, “out of province registered nurse in the extended class”, “out of province registered nurse in the general class” and “out of province registered practical nurse” in section 1 of the Regulation are revoked and the following substituted:
“health professional” means a member of a College of a health profession referred to in Schedule 1 to the Regulated Health Professions Act, 1991, an out of province dentist, an out of province dietitian, an out of province medical laboratory technologist, an out of province midwife, an out of province pharmacist, an out of province pharmacy technician, an out of province physician, an out of province registered nurse in the general class, an out of province registered nurse in the extended class or an out of province registered practical nurse; (“professionnel de la santé”)
“out of province physician” means a person who is exempted from subsections 9 (1) and (3) of the Medicine Act, 1991 by a regulation made under that Act and who holds the equivalent of a certificate of registration authorizing independent practice in Ontario; (“médecin hors province”)
“out of province registered nurse in the extended class” means a person who is exempted from subsections 11 (1) and (5) of the Nursing Act, 1991 by a regulation made under that Act and who holds the equivalent of a certificate of registration in the extended class for registered nurses in Ontario; (“infirmière autorisée ou infirmier autorisé de la catégorie supérieure hors province”)
“out of province registered nurse in the general class” means a person who is exempted from subsections 11 (1) and (5) of the Nursing Act, 1991 by a regulation made under that Act and who holds the equivalent of a certificate of registration in the general class for registered nurses in Ontario; (“infirmière autorisée ou infirmier autorisé de la catégorie générale hors province”)
“out of province registered practical nurse” means a person who is exempted from subsections 11 (1) and (5) of the Nursing Act, 1991 by a regulation made under that Act and who holds the equivalent of a certificate of registration in the general class for registered practical nurses in Ontario; (“infirmière auxiliaire autorisée ou infirmier auxiliaire autorisé hors province”)
2. Clauses 17 (b) and (c) of the Regulation are revoked and the following substituted:
(b) a member of the Royal College of Dental Surgeons of Ontario or an out of province dentist;
(c) a member of the College of Midwives of Ontario or an out of province midwife;
3. (1) Clauses 18 (1) (b) and (c) of the Regulation are revoked and the following substituted:
(b) a member of the Royal College of Dental Surgeons of Ontario or an out of province dentist;
(c) a member of the College of Midwives of Ontario or an out of province midwife, but only in respect of a test specified in Schedule 2;
(2) Clause 18 (1) (g) of the Regulation is revoked and the following substituted:
(g) a member of the Ontario College of Pharmacists who is registered as a pharmacist under the Pharmacy Act, 1991 or an out of province pharmacist, but only in respect of a test for COVID-19;
4. Subsection 25.1 (1) of the Regulation is revoked and the following substituted:
Midwives and aboriginal midwives
(1) A member of the College of Midwives of Ontario and an out of province midwife are exempt from sections 9 to 16 of the Act and from this Regulation with respect to performing one or more point-of-care tests listed in subsection (3) in the course of their midwifery practice.
5. (1) Subsection 28 (1) of the Regulation is amended by striking out the portion before paragraph 1 and substituting the following:
Pharmacists and pharmaceutical chemists
(1) The persons listed in subsection (1.1) are exempt from sections 9 to 16 of the Act and from this Regulation with respect to the following, if the persons carry them out for the exclusive purpose of assisting individuals with the management of their medication to treat chronic disease:

(2) Section 28 of the Regulation is amended by adding the following subsection:
(1.1) The persons mentioned in subsection (1) are as follows:
1. A member of the Ontario College of Pharmacists who is registered as a Part A pharmacist, an intern, a Part A pharmacy technician or an intern technician under the Pharmacy Act, 1991.
2. An out of province pharmacist.
3. An out of province pharmacy technician.
(3) Subsection 28 (4) of the Regulation is amended by adding the following paragraph:
1.1. An out of province pharmacist or an out of province pharmacy technician.
6. Paragraphs 3 and 4 of subsection 31 (1) of the Regulation are revoked and the following substituted:
3. A member of the Royal College of Dental Surgeons of Ontario or an out of province dentist.
4. A member of the Ontario College of Pharmacists who is registered as a pharmacist under the Pharmacy Act, 1991 or an out of province pharmacist.
7. Paragraphs 3 and 4 of section 34 of the Regulation are revoked and the following substituted:
3. A place where a member of the College of Dietitians of Ontario or an out of province dietitian is engaged in the practice of dietetics.
4. A place where a member of the College of Midwives of Ontario or an out of province midwife is engaged in the practice of midwifery.
Commencement
8. This Regulation comes into force on the later of January 1, 2026 and the day this Regulation is filed.
