Wool

CONTENTS

 

Definitions

1. In this Regulation,

“warehouser” means a person who operates an establishment where wool is assembled, graded, bought, offered for sale or sold; (“grossiste”)

“wool collector” means a person who collects ungraded wool from persons engaged in the production of wool and engages in the business of storing wool. (“collecteur de laine”)

Part V designated product

2. (1) Wool is designated as a Part V designated product.

(2) Sections 10 to 15, subsections 16 (3) to (6) and sections 17 to 21 of the Act do not apply to wool.

Exemption

3. Warehousers are exempt from the requirements of Part V of the Act.

Wool grading

4. For the purposes of this Regulation, the grades of wool are set out in the following Table:

Wool to be graded by warehouser

5. Wool shall be graded only on premises operated by a warehouser.

Wool collection

6. (1) At the time of collecting or receiving a lot of wool from a person engaged in the production of wool, a wool collector shall identify each lot as to ownership and deliver to the person a copy of a receipt showing,

(a) the name and address of the wool collector;

(b) the name of the warehouser to whom the wool is to be delivered;

(c) the name and address of the person engaged in the production of wool;

(d) whether payment to the person engaged in the production of wool is to be on the basis of graded or ungraded wool;

(e) the date of collection or receipt;

(f) the number of packages in each lot;

(g) the signature of the wool collector; and

(h) the signature of the person engaged in the production of wool.

(2) The wool collector shall retain a copy of the receipt for at least six months and give one copy to the warehouser to whom the wool is to be delivered.

Payment for graded wool

7. (1) If payment to a person engaged in the production of wool is to be made on the basis of graded wool, the warehouser shall grade the wool within one month of receiving it.

(2) After the wool has been graded, the warehouser shall complete a wool grading certificate for each lot of wool received.

(3) The warehouser shall deliver to the person engaged in the production of wool a copy of the wool grading certificate when making payment for the wool and shall retain a copy of the statement for one year.

(4) A wool grading certificate shall include the following information:

1. The grades of the wool.

2. The name, address and telephone number of the warehouser.

3. The name, address and account number of the person engaged in the production of wool.

4. The name of the wool collector who collected or received the wool.

5. The lot number of the wool.

6. The number of sacks of wool in the lot.

7. The gross weight, tare weight and net weight of the lot.

8. The pounds of wool, price per pound and total price for each grade of wool in the lot.

9. The total price, price adjustments and net price of the wool in the lot.

10. The grader’s name.

11. The date the wool was received by the warehouser and the date it was graded.

Applying grades, sales by grade

8. No person shall apply a grade to wool or sell or offer for sale wool by grade except in accordance with this Regulation.

Non-application — manufacturers of woollen goods

9. This Regulation does not apply to wool delivered or consigned by a person engaged in the production of wool to a manufacturer of woollen goods to be carded or otherwise processed.

Commencement

10. This Regulation comes into force on the later of the day section 2 of Schedule 30 (Protecting Farmers from Non-Payment Act (Regulating Agricultural Product Dealers and Storage Operators), 2023) to the Less Red Tape, Stronger Economy Act, 2023 comes into force and the day this Regulation is filed.
