Amending O. Reg. 69/01
(GENERAL)
1. Clause 2 (4) (b) of Ontario Regulation 69/01 is revoked and the following substituted:
(b) obtained from the ministry, any department or agency of the Government of Canada having responsibility for public safety and security or any law enforcement agency in Canada.
2. The Regulation is amended by adding the following sections:
Prescribed entities, s. 10 (3.0.2) of the Act
3.1 The following entities are prescribed for the purpose of subsection 10 (3.0.2) of the Act:
1. Any law enforcement agency in Canada or outside of Canada, other than an entity mentioned in subsection 10 (3.0.1) of the Act.
2. Any ministry, department or agency of the Government of Canada or of a province or territory having responsibility for public safety and security.
Agreements, s. 10 (3.0.3) of the Act
3.2 (1) The ministry shall ensure that an agreement required under subsection 10 (3.0.3) of the Act provides for the following:
1. A description of the information to be disclosed.
2. The purpose of the disclosure.
3. Whether and how the information will be compared or, by electronic means, combined or linked with other information and the purpose of any such comparison, combination or linkage.
4. A prohibition against the use of the information for any purpose other than the purpose set out in the agreement.
5. A prohibition against public disclosure of the information.
6. An identification of the position titles of the individuals within the recipient entity who will have access to the information.
7. The period of time that the information will be retained by the recipient entity.
8. An explanation of the specific manner in which the recipient entity will securely retain the information.
9. A prohibition on the recipient entity disclosing any of the information unless the disclosure is specifically authorized by the agreement and, if the agreement authorizes the disclosure of the information, an explanation of the specific process that the recipient entity will use to securely disclose the information.
10. An explanation of the specific process the recipient entity will use to return, dispose of or destroy the information in a secure manner following the end of the retention period and the timeframe within which this will be accomplished.
11. A requirement for the recipient entity to take reasonable steps to prevent privacy and security breaches in relation to the information and mitigate any related risks to individuals.
12. A requirement for the recipient entity to report to the ministry any actual or suspected privacy or security breaches in relation to the information.
(2) The ministry shall not enter into an agreement required under subsection 10 (3.0.3) of the Act respecting the disclosure of information if the primary purpose of the disclosure is to investigate penal liability.
3. (1) Subsection 6 (2) of the Regulation is revoked and the following substituted:
(2) The ministry may enter into an agreement with any department or agency of the Government of Canada having responsibility for public safety and security, national defence or immigration and citizenship to obtain any information in their possession or control for the purposes of adding the information to the sex offender registry.
(2) The English version of subsection 6 (3) of the Regulation is amended by striking out “any department or agency of the government of Canada” and substituting “any ministry, department or agency of the Government of Canada”.
4. The Table of Forms to the Regulation is revoked and the following substituted:

Commencement
5. (1) Except as otherwise provided in this section, this Regulation comes into force on the later of the day subsection 1 (3) of Schedule 3 to the Protect Ontario by Cutting Red Tape Act, 2025 comes into force and the day this Regulation is filed.
(2) Section 4 comes into force on the later of April 1, 2026 and the day this Regulation is filed.
